form of government on several occasions — for example, confirming <br />that the Council's Rules of Procedure do not violate the Plan B <br />form of government — which legal advice from Mr. Jamnik has <br />seemed to please this Mayor and a majority of this Council. <br />3. The alle�ation is that Campbell Knutson coordinated or <br />participated in ille�al serial consecutive meetin�s of Roseville <br />Councilmembers. MY conclusion is that never happened, and <br />that Mr. Jamnik has in fact been diligent in tryin� to prevent <br />Councilmember communications that might violate the <br />Minnesota Open Meeting Act. <br />Around 1999, before Mayor Kysylyczyn was elected, CUB Foods' sought <br />City Council permission to build a 24-hour super market part way inside <br />but mostly outside the footprint of the Har Mar Mall building. Several <br />Roseville residents, mostly neighbors living along the adjacent streets, <br />opposed CUB Foods' request. Part of the Roseville Council's response to <br />CUB's building request was to declare a moratorium on building <br />shopping center businesses that operated 24-hours a day. This was to <br />freeze temporarily the situation while CUB, the neighbors, and the City <br />Council tried to find a compromise. Before a City Council Meeting where <br />the moratorium was on the agenda, two Councilmembers separately <br />sought Mr. Jamnik's advice about the legality of such a moratorium. <br />My findings on this allegation are that: <br />. No one at Campbell Knutson coordinated or participated in illegal <br />serial consecutive meetings with Councilmembers — Mr. Jamnik <br />met separately, and briefly, with two Councilmembers about the <br />proposed moratorium before the meeting, but he did not tell one <br />Councilmember what the other Councilmember said, he just <br />shared his legal opinion about a building moratorium, and he did <br />not begin or contribute to a chain of communication that may <br />violate the Minnesota Open Meeting Act; <br />. On many occasions, lawyers from Campbell Knutson, including <br />Mr. Scott and Mr. Jamnik, have either met or spoken with <br />individual Roseville Councilmembers and the Mayor at their <br />request about the legal aspects of an upcoming agenda item; <br />. On several occasions, Mr. Jamnik has given legal advice to the <br />current Roseville City Council to avoid communications that may <br />violate the Minnesota Open Meeting Act. <br />3 <br />
