WHEREAS, the present owners and other persons having an interest in said required lands have indicated that they are unwilling to negotiate with the Village on a reasonable basis for the acquisition of the same; and WHEREAS, the statutes of the State of Minnesota state that the Village has the power and authority to take and acquire said property by condemnation under the power of eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL FOR THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: The Village Council hereby deems that it is necessary and convenient that an easement over the property described below be acquired by said Village by condemnation under the power of eminent domain, all of said property being situated in the County of Ramsey and State of Minnesota, to-wit: The South Ten Feet (S.lO') of Lot Three (3), Block Eleven (11), Fernwood Terrace, Plat Five (5), and the South Ten Feet (S. 10') of Lot Fourteen (14), Block Eleven (II), Fernwood Terrace, Plat Five (5), according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota. That the estate to be acquired in the property described above is a perpetual easement for the purpose of construction of a storm sewer over, across and under the above described property, together with perpetual ingress and egress for the repair of storm sewer mains. That the Village Attorney be and he hereby is instructed to institute the necessary proceedings in condemnation under the power of eminent domain in the name and in behalf of the Village of Roseville, Minnesota, to acquire the property hereinabove described under the statutes of the State of Minnesota, and the said attorney is further instructed and directed to take such steps as may be necessary to carry said proceedings to a conclusion.
