1 Agreement for Comprehensive Recycling Services 2 3 4 5 This Agreement "Agreement is made on the day of 20 6 between the City of Roseville, a municipal corporation (hereinafter "City and The 7 Neighborhood Recycling Corporation d.b.a. Eureka Recycling, a Minnesota Corporation, with its 8 principal place of business at 2828 Kennedy Street Northeast, Minneapolis, Minnesota 55413 9 (hereinafter "Contractor 10 11 Preliminary Statement 12 13 The City has adopted a policy regarding the selection and hiring of contractors to provide a 14 variety of professional services for City projects. That policy requires that persons, firms or 15 corporations providing such services enter into written agreements with the City. The purpose of 16 this Agreement is to set forth the terms and conditions for the performance of professional 17 services by the Contractor. 18 19 The City and Contractor agree as follows: 20 21 1. Scope of Work Proposal. The Contractor agrees to provide t'he comprehensive recycling 22 services shown in Section 5 (General Requirements for All Collections), Section 6 23 (Annual Reporting and Promotional Activities}) and Section 7 (Materials Processing and 24 arketmg z catlar: :0` d te. l?r,:.- c'b.:r --ef e Ciaect for P r epesals —as 25 ?osi-atec' —ir :.e4r7 —T#e) of the Contractor's Proposal a-tehed- hereto ("Work") in 26 consideration for the compensation set forth in Provision 3 below. The Work shall be 27 performed usingTwo- Stream Collection illustrated in Section Three of the Contractor's 28 Proposal. The ?,e.fonnance of the Work shall be, subject to the provisions contained in 29 Section 8.45 (Liquidated Damages) of the Subcontractor's Proposal which provisions are 30 incorporated into and made En integral and binding of this` reement. Section 5, 6, 31 7, 8.05 and Scction Three of the Contractor's Proposal are attached hereto as Exhibit A. 32 The Contractor also agrees to collect, process and market pizza boxes as part of the 33 vt >lork to be performed. Pizza boxes are defined as cardboard material with double 34 wall construction and corrugated separation between walls used in delivery or pick -up of 35 pizza restaurants. The work plan shall 41 include initiatives the Contractor will undertake to improve the City's recycling program. 42 43 2. Term. The term of this Agreement shall be from January 1, 2011, through December 31, 44 2013, the date of signature by the parties notwithstanding. 45 1
