46 3. Compensation for Services. The City agrees to pay the Contractor the following <br /> 47 compensation: <br /> 48 <br /> 49 City agrees to pay Contractor $2.53 per residential dwelling unit per month in 2011 for <br /> 50 weekly curbside collection, processing and marketing of recyclables. For 2011 the City <br /> 51 certifies that there are 9,429 residential curbside units that will receive service. The City <br /> 52 will notify the Contractor by December 1 of each year what the certified number of <br /> 53 curbside units will be for the subsequent year. In 2012 the City will pay Contractor $2.58 <br /> 54 per residential dwelling unit per month; and $2.63 per residential dwelling unit in 2013. <br /> 55 <br /> 56 The City agrees to pay Contractor $2.53 per certified multi- family dwelling unit per <br /> 57 month in 2011. City shall determine the number of units that will receive service during a <br /> 58 given month by the last Monday of the previous month. For 2011 the City certifies that <br /> 59 there are 5,902 residential multi family dwelling units. In 2012 the City will pay <br /> 60 Contractor $2.58 per multi- family dwelling unit per month; and $2.63 per multi family <br /> 61 dwelling unit in 2013. <br /> 62 <br /> 63 Compensation will be subject to the following: <br /> 64 <br /> 65 A. Any changes in the Work which may result in an increase to the compensation due <br /> 66 the Contractor shall require prior written approval of the City. The City will not pay <br /> 67 additional compensation for Work that does not have such prior written approval. <br /> 68 <br /> 69 B. Third party independent contractors and/or subcontractors may be retained by the <br /> 70 Contractor when required by the complex or specialized nature of the Work when <br /> 71 authorized in writing by the City. The Contractor shall be responsible for and shall <br /> 72 pay all costs and expenses payable to such third party contractors unless otherwise <br /> 73 agreed to by the parties in writing. <br /> 74 <br /> 75 4. City Assistance. The City agrees to provide the Contractor with the following assistance <br /> 76 concerning the Work to be performed hereunder: <br /> 77 <br /> 78 A. Depending on the nature of the Work, Contractor may from time to time require <br /> 79 access to public and private lands or property. To the extent the City is legally and <br /> 80 reasonably able, the City shall provide access to and make provisions to enable the <br /> 81 Contractor to enter upon public and private land and property as required for the <br /> 82 Contractor to perform and complete the Work. <br /> 83 <br /> 84 B. The City shall furnish the Contractor with a copy of any special standards or criteria <br /> 85 promulgated by the City relating to the Work that is needed by the Contractor in order <br /> 86 to prepare for the performance of the Work. <br /> 87 <br /> 88 C. The Recycling Coordinator Tim Pratt shall act as the City's representative with <br /> 89 respect to the Work to be performed under this Agreement. Such representative shall <br /> 90 have authority to transmit instructions, receive information, interpret, and define the <br /> 91 City's policy and decisions with respect to the Work to be performed under this <br /> 2 <br />
