R egular City Council Meeting <br /> Monday, December 06, 2010 <br /> Page 29 <br /> Councilmember Johnson questioned the design standards proposed for enclosures <br /> for waste and recycling areas; and whether that was applicable to existing parks or <br /> future developments. Councilmember Johnson noted that he'd received com- <br /> ments from neighbors that the enclosures would be more open to vandalism, po- <br /> tential shelter for vagrants, and questioned how staff would address that. Coun- <br /> cilmember Johnson further questioned how the 20' setback would be applied for <br /> future pathways. <br /> Staff advised that the code applied to new improvements, not existing; that the <br /> enclosures were for large dumpsters and usually applicable by parking areas; ex- <br /> amples of uses at Central Park and the OVAL. Staff noted that, upon review of <br /> the draft zoning code, Ramsey County had brought forward concerns regarding <br /> the buffer strip area and its relationship to pathways. <br /> Councilmember Johnson suggested an exception be made providing more leeway <br /> to facilitate future connectivity and pathway /trails development. <br /> Councilmember Roe noted that on Page 3 of the Design Standards (d) exclusions <br /> were listed, including abutting pathways residential districts. <br /> Staff concurred. <br /> Procedures Chapter 1009 <br /> Staff advised that the purpose of this chapter was to specify how zoning related <br /> applications are reviewed and processed; a reorganization of how different land <br /> use applications are processed; how existing procedures are dispersed in current <br /> code, with all now combined in the Procedures chapter. Staff advised that more <br /> robust requirements for most conditional uses were applied; additional types of <br /> administration deviations clarified in order to accommodate minor improvements <br /> since variances are practically unavailable with recent restrictive state legislation; <br /> and references to Subdivision and Comprehensive Plan changes eliminated as <br /> these processes are regulated elsewhere (e.g. Subdivisions). <br /> Councilmember Roe expressed his appreciation for how this section was put to- <br /> gether, its clarity; and how the Conditional Use criteria were now basically incor- <br /> porated rather than as separate conditions applied in past Conditional Use applica- <br /> tions. <br /> Property Performance Standards Chapter 1011 <br /> Staff advised that current Performance Standards had been revised, with the coop- <br /> eration of the City Attorney; and included new Environmental Standards for all <br /> non residential districts requiring compliance prior to Building Permits being is- <br /> sues; a new section created for tree preservation, essentially for new develop <br /> ment/redevelopment and significant commercial improvements; updated require- <br />
