<br />of said land and that said restrictions would be arbitrary, serving no useful <br />purpose in zoning, <br /> <br />NOW, THEREFORE, The council hereby determines the fOllowing: <br /> <br />1. The owners of the above described land have restricted or are in <br />the process of restricting the use of said lands by covenants of title as <br />set forth above. <br /> <br />a. Based on said restrictions of use of land there will <br />not be the amount of motor vehicle traffic usually generated by <br />said use. <br /> <br />b. Based on said restrictions of use of land there will <br />be no rea sonable need to apply a floor area to land area ratio of .5. <br /> <br />c. Based on said restrictions of use of land the normal <br />size of the apartments is no longer required for good planning. <br /> <br />d. Normal restrictions for lot size per unit would not <br />apply since there would be no children in the apartments using <br />said land. <br /> <br />2. The Council hereby grants special use permit and variance referred <br />to above. <br /> <br />3. That the said special use permits and variances are granted subject <br />to the following conditions: <br /> <br />a. All building and use of said land shall be in accordance <br />with the site and regrading plans, drainage and utility plans, plans for <br />building sections and floor plans on file with the village and filed <br />by the applicants. <br /> <br />b. All restrictions on the use of said land referred to in <br />covenants of title apply as conditions to the granting of the special <br />use permit and variances. <br /> <br />c. The applicant is filing a new landscape plan and no <br />construction or building permits shall be issued until the Village <br />Planner approves said landscaping plan. <br /> <br />d. There shall be no building erected closer than 80 <br />feet to the right-of-way of Dionne Street. <br /> <br />The motion for the adoption of the foregoing Resolution was duly <br />seconded by Member Brerman ' and upon a vote being taken, <br />the following voted in favor of the resolution: <br /> <br />^1"1 .;:r---- <br />
