Restrictions in occupancy shall be limited to no more than two <br />persons per apartment; and <br /> <br />2. At least one person occupying each apartment to be constructed <br />on said property shall be: <br /> <br />(i) at least 60 years old, or be defined as "elderly" <br />under the National Housing Act, as amended or <br />superseded. <br /> <br />(11) be eligible for retirement under applicable social <br />security regulations, as amended from time to time; <br />or <br /> <br />(11i) be physically handicapped, as certified by a physician, <br />in accordance with Department of Housing and Urban <br />Development Regulations, as amended from time to time. <br /> <br />3. The restrictions set forth shall automatically terminate, and be or <br />no kfurther force and effect on June 1, 2002; and <br /> <br />WHEREAS, the council has determined that the number of restrictions <br />on parking, size of apartment, ratio of floor space to land space, number of <br />apartments and height of building would place unusual hardships on the use <br />
