<br />of said easements more specifically set forth therein, and <br /> <br />WHEREAS, the owner of said property on which said <br />perpetual easement is located is Rdberts Construction, Inc., <br />a Minnesota corporation, which now desires to build a ware- <br />house on said property, part of which will be located on <br />said described easement, and <br /> <br />WHEREAS, there is presently in place within the <br />easement area an interceptor sewer line which serves a con- <br />siderable portion of Rosevilles industrial area, and <br /> <br />WHEREAS, Roberts Construction, Inc., requests that <br />the Village of Roseville allow the construction of said ware- <br />house and, in return, is willing to indemnify and hold the <br />Village of Roseville harmless from any claims or damage to <br />said sewer interceptor arising out of the construction of <br />said warehouse and will reimburse the Village of Roseville <br />for any costs sustained by the Village in repairing any <br />damage to the sewer interceptor and agrees to assume all <br />risks of damage to itself and others by reason of the ware- <br />house construction over the sewer interceptor. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE <br />COUNCIL FOR THE VILLAGE OF ROSEVILLE, AS FOLLOWS: <br /> <br />The village of Roseville hereby agrees to permit <br />the construction of said warehouse by Roberts Construction, <br />Inc., in consideration of an agreement for reimbursement of <br />any damage or cost to the village, and indemnification, and <br />a hold harmless agreement, and for that purpose, the village <br />Mayor and village Manager are hereby authorized and directed <br />to execute, on behalf of the village of Roseville, an Agreement <br />dated March 26, 1973, a copy of which is attached hereto, which <br />has already been executed by Donald V. Roberts, president and <br />Marie A. Roberts, Secretary on behalf of Roberts Construction, <br />Inc. <br /> <br />The motion for the adoption of the foregoing Re- <br />solution was duly seconded by Member Anderson <br />and upon a vate being taken, the following voted in favor of <br />
