<br />did you would have to give a credit for the previous assess- <br />ment so you run into a practical problem from that aspect so <br />the improvement as it now stands - if you want to go to $205,000 <br />we have the legal framework to do it and it meets the ramifica- <br />tions of the local improvement code. If you start moving to <br />add three hundred some thousand to the $205,000 that's a substan- <br />tive change that would require republishing notices. <br /> <br />MAYOR LINEBARGER: Thank you, Mr. Popovich. Before open- <br />ing the meeting to the public I would like to call on our Manager. <br />He has two petitions and r'll ask if he has other letters and <br />communications. I would like to comment that this program was <br />initially initiated because a petition was received that had <br />signatures of 35% of the property owners within the affected <br />area. Since then we have received another petition against <br />the improvement and there were some people who signed both peti- <br />tions and that would nullify the signature on the original <br />petition so that is now down to 22%. So if there is a vote to- <br />night on this project it would take a four-fifths vote on the <br />part of the Council because the adequate percentage is no longer <br />there. <br /> <br />MR. ANDRE: We have received a petition for the local im- <br />provement initially and a petition opposing the improvement with <br />85 signatures and we have determLned that 79 of those signatures <br />are properly within the project area. Twenty had previously <br />signed the original petition and this leaves 35 valid signa- <br />tures on the original petition, or 22% out of a total of 160. <br /> <br />MAYOR LINEBARGER: I will open the hearing to the public. <br />We're making a transcription as required by law and I ask that <br />each speaker ide~tify himself and give his address and indicate <br />that he lives in this proposed area and what piece of property <br />it is that he's referring to if he does not live within the <br />particular area.
