did you would have to give a credit for the previous assess- ment so you run into a practical problem from that aspect so the improvement as it now stands - if you want to go to $205,000 we have the legal framework to do it and it meets the ramifica- tions of the local improvement code. If you start moving to add three hundred some thousand to the $205,000 that's a substan- tive change that would require republishing notices. MAYOR LINEBARGER: Thank you, Mr. Popovich. I would like to comment that this program was initially initiated because a petition was received that had signatures of 35% of the property owners within the affected area. Since then we have received another petition against the improvement and there were some people who signed both peti- tions and that would nullify the signature on the original petition so that is now down to 22%. So if there is a vote to- night on this project it would take a four-fifths vote on the part of the Council because the adequate percentage is no longer there. MR. ANDRE: We have received a petition for the local im- provement initially and a petition opposing the improvement with 85 signatures and we have determLned that 79 of those signatures are properly within the project area. Twenty had previously signed the original petition and this leaves 35 valid signa- tures on the original petition, or 22% out of a total of 160.
