WHEREAS, the statutes of the State of Minnesota state that the Village has the power and authority to take and acquire said property by condemnation under the power of eminent domain; NOW, THEREFORE, BE IT RESOLVED By the Village Council for the Village of Roseville, Minnesota, as follows: The Village Council hereby deems that it is necessary and convenient that an easement over the property described below be acquired by said Village by condemnation under the power of eminent domain, all of said property being situated in the County of Ramsey and State of Minnesota, to-wit: Tract A: The North Fifty Feet (N. 50') of the East Eighty-Three Feet (E. 83'), subject to Cleveland Avenue, of the following described real property: That part of the Northeast Quarter of the Northeast Quarter (NE.l/4 of NE.l/4) of Section Five (5), Township Twenty-Nine (29), Range Twenty-Three (23), described as follows: Commencing at a point in the East line of said Section Five (5), One Thousand Three Hundred Forty Feet (1340') South of the Northeast corner of said Section Five (5), thence West parallel with the North Line of said Section a distance of Three Hundred Sixty-Three Feet (363'), thence South parallel with the East line of said Section a distance of One Hundred Twenty Feet (120'), thence West parallel with the North line of said Section a distance of One Hundred Eighty-One and one-half feet (181-1/2') thence North parallel with the East line a distance of Two Hundred Forty Feet (240'), thence East parallel with the North line a distance of Five Hundred Forty-Four and one- half feet (544-1/2'), thence South along the East line a distance of One Hundred Twenty Feet (120') to the point of beginning.
