<br />property owners as required by law and published in the <br />legal newspaper. <br /> <br />6. The maps that were mailed with the notices <br />to all property owners were accurate. The legal descrip- <br />tions contained a clerical error. Attached as Exhibits E <br />and F are copies of the notices as they were sent out con- <br />taining the error. Also attached as Exhibits G and Hare <br />notices shown as they should have been sent out without <br />containing any error. Said Exhibits E, F, G and Hare <br />attached hereto and made a part hereof by reference. <br /> <br />WHEREAS, pursuant to said notices certain public <br />hearings were held and the City Council has determined that <br />all explanations made by proponents and opponents of the <br />rezoning were accurate. Those explaining the rezoning <br />and those resisting the rezoning were apparently unaware <br />of the clerical errors referred to above. <br /> <br />The maps used at the explanation of the public <br />hearings were all accurate as were all explanations. <br /> <br />WHEREAS, Ordinance No. 794 was adopted pursuant <br />to application and Council action and said Ordinance <br />contained the same errors in the legal description. <br /> <br />NOW, THEREFORE, the City Council of the City of <br />Roseville hereby determines, finds and orders as follows: <br /> <br />1. The City Council determined that all errors <br />occurring above, were clerical errors and subject to cor- <br />rections. <br /> <br />2. The City Council determines that no interested <br />party was or was likely to be prejudiced by said clerical <br />errors. <br /> <br />3. The City Council hereby directs that the <br />City Attorney prepare a new Ordinance correctly rezoning <br />said property. <br /> <br />The motion for the adoption of the <br />resolution was duly seconded by Member Hess <br />upon a vote being taken, the fOllowing voted <br />the resolution: All present <br />and the following voted against the same: None <br /> <br />foregoing <br />, and <br />in favor of <br /> <br />WHEREUPON, the said resolution was declared duly <br />passed and adopted. <br /> <br />-2- <br />
