/11388 Mr. Wehrle was satisfied as long as he was assured of a review process to allow further dialogue <br /> INIF389 and participation. <br /> 390 Liz Jaeger, 1307 W Roselawn Avenue <br /> 391 Ms. Jaeger expressed concern, specific to Ryan Street and that neighborhood, how existing and/or <br /> 392 future group homes would be impacted, and how they fit with single family residential land use <br /> 393 designations. <br /> 394 Mr. Paschke noted that group homes were permitted under MN State Statute, along with group <br /> 395 family daycare centers and other care use facilities within certain zoning districts; with the City <br /> 396 having limited ability to regulate their use. <br /> 397 Cindy Schwie, 1353 Ryan Avenue <br /> 398 Ms. Schwie provided, as a bench handout, a copy of the flyer that she had created and distributed <br /> 399 to the neighborhood residents. <br /> 400 Ms. Schwie sought assurances that there were no plans to remove the existing fence on the south <br /> 401 side of Har Mar Mall, nor any plans to open up roads for additional access to the site, with Mr. <br /> 402 Paschke reiterating previous statements to that affect, and reviewed the process for any proposed <br /> 403 changes at Har Mar needing to be done through that property owners' application for a Planned <br /> 404 Unit Development (PUD) Amendment public process, with their current PUD having been <br /> 405 established in the early 2000's, and that mailed notice would be provided to neighbors within <br /> 406 500' of the parcel, in addition to published notice. At the request of Commissioners, Mr. Paschke <br /> 0 407 noted that even if the application was made, the City would be under no obligation to find in <br /> 408 favor of and approve such an amendment, even if the applicant requested additional access, since <br /> 409 the same issues were retained for the Har Mar Mall parcel guided in the Comprehensive Plan for <br /> 410 Community Business adjacent to a residential neighborhood. <br /> 411 Chair Doherty assured residents in the audience that it would be highly unlikely for the current <br /> 412 Planning Commission and/or City Council, and most likely any future bodies, to look favorably <br /> 413 on such a request that would increase traffic on the south side of the Har Mar Parcel into the <br /> 414 residential neighborhood. <br /> 415 Ms. Schwie expressed concern in the language used in the post card notice that the Public <br /> 416 Hearing was to consider a zoning "update," rather than "rezoning," given that the specific two (2) <br /> 417 lots south of Har Mar were proposed to go from R -1 to Commercial Business, signifying a major <br /> 418 change; and opined that such information should have been included on the post card notice. Ms. <br /> 419 Schwie expressed further concern that such land use designation could allow an apartment <br /> 420 building on the south side, which was also of great concern to the neighborhood. <br /> 421 Chair Doherty advised that flyers were generic since they were provided to all designated <br /> 422 property owners in the City, and that individual notices would not have been feasible. <br /> 423 Ms. Schwie alleged that Har Mar Mall's zoning is not currently completely zoned Shopping <br /> 424 Center, but that a small portion on the south side was actually designated B l -B and R -1. <br />
