NORMAN ALBRECHT, 3069 West Owasso Boulevard: Asked <br />if he would be assessed again at some future time if something <br />is done to control the level of the pond on his property. <br /> <br />MRS. MARIA HINZ, 2995 West Owasso Boulevard: Mr. Andre had <br />referred to the communication received from Mr. Gene Hinz, and <br />Mrs. Hinz wished to tell the Council that the facts stated in <br />the letter are what they feel. <br /> <br />No one else wished to be heard and Mayor Demos closed the <br />hearing. <br /> <br />MR. JOHN MORRISON, 3151 West OWasso Boulevard: Said the <br />state law provides that unless a benefit to the property can be <br />shown by an appraisal before and after construction of an <br />improvement there can be no assessment and he felt the Council <br />should consider the legality of the assessment. <br /> <br />Councilman Curley then introduced the following resolution <br />and moved its adoption: <br /> <br />Resolution No. 6871 <br /> <br />RESOLUTION ADOPTING AND CONFIRMING <br />ASSESSMENTS FOR IMPROVEMENT NO. P-ST-76-23 <br /> <br />BE IT RESOLVED by the City Council of the City of Roseville, <br /> <br />Minnesota, as follows: <br /> <br />1. The amount proper and necessary to be specially <br />assessed at this time for Improvement No. P-ST-76-23 against <br />every assessable lot, piece or parcel of land affected thereby <br />has been duly calculated upon the basis of benefits, without regard <br />to cash valuation, in accordance with the provisions of Minne- <br />sota Statutes, Chapter 429, as amended, and notice~has been <br />duly mailed and published, as required by law, that this Council <br />would meet to hear, consider and pass upon all objections, if <br />any, and said proposed assessment has at all times since its <br />filing been open for public inspection, and an opportunity has <br />been given to all interested persons to present their objec- <br />tions, if any, to such proposed assessments. <br /> <br />2. This Council, having heard and considered all objec- <br />tions so presented, and being fully advised in the premises, <br />finds that each of the lots, pieces and parcels of land enumer- <br />ated in the proposed assessment was and is specially benefited <br />by the construction of said improvement in not less than the <br />amount of the assessment set opposite the description of each <br />such lot, piece and parcel of land, respectively, and such <br />amount so set out is hereby levied against each of the respec- <br />tive lots, pieces and parcels of land therein. <br />
