Planning Commission Special Meeting <br />Minutes – Wednesday, September 29, 2010 <br /> <br />Page 2 <br />questioned the apparent opposition he’d heard from neighbors in his proposed <br />48 <br />redevelopment of the property; however, he maintained his rights to use his <br />49 <br />property as he chose. <br />50 <br />Mr. Lloyd advised Commissioners and Mr. O’Leary that the parcel(s) were <br />51 <br />currently zoned R-1 (Single-family residential); but was guided in the <br />52 <br />Comprehensive Plan update to be designated and rezoned to Institutional use. <br />53 <br />Mr. Paschke reviewed how and why the property was initially identified as an <br />54 <br />anomaly property with the Comprehensive Plan guiding them to Institutional, but <br />55 <br />recommended by staff to reconsider designation and rezoning as Low Density <br />56 <br />Residential-1 (LDR-1). However, Mr. Paschke advised that, following <br />57 <br />discussions among School District and City staff, it was determined that, given <br />58 <br />the proximity of the parcels to an Institutional Use (School), it was appropriate for <br />59 <br />it to be guided Institutional and guided as such in the Comprehensive Plan; <br />60 <br />removing those parcels from the other anomaly properties being considered. <br />61 <br />Mr. Paschke advised that Mr. O’Leary’s next step would be to apply for a <br />62 <br />Comprehensive Plan Amendment and Rezoning to change that designation to <br />63 <br />LDR (Low Density Residential). <br />64 <br />Member Wozniak questioned why staff didn’t consider the parcels for MDR <br />65 <br />(Medium Density Residential) since there were apartment buildings across the <br />66 <br />street; with Mr. Paschke responding that designation and rezoning could be <br />67 <br />considered if an application came forward; however, he clarified that such a <br />68 <br />request was not being staff-driven, or City-initiated. <br />69 <br />Mr. O’Leary expressed his frustration in this information not being provided more <br />70 <br />clearly before his significant investment of time in attending past meetings; and <br />71 <br />expressed his interest in proceeding with an application for land use designation <br />72 <br />and zoning changes; and further expressed his interest in selling his home in <br />73 <br />Maplewood and becoming a resident of Roseville. <br />74 <br />b. From the Commission or Staff <br />75 <br />In the interest of the majority of those in attendance at tonight’ meeting, and with <br />76 <br />Commissioner consensus, Chair Doherty amended the agenda to move the <br />77 <br />Public Hearing for Item 5.3 as the first case to be heard. <br />78 <br />5. Public Hearings <br />79 <br />Chair Doherty reviewed the purpose and process for public hearings before the Planning <br />80 <br /> <br />Commission. <br />81 <br />a. PROJECT FILE 0004 AND 0017 <br />82 <br />Request by the Roseville Planning Division to consider changing the 2030 <br />83 <br />Comprehensive Land Use Plan designation of 3253 and 3261 Old highway 9 <br />84 <br />from High Density Residential to Low Density Residential and the <br />85 <br />subsequent rezoning of the same parcels from High Density Residential <br />86 <br />(HDR) to Low Density Residential 1 (LDR-1) <br />87 <br />Chair Doherty opened the Public Hearing for PROJECT FILE 0017. <br />88 <br />City Planner Thomas Paschke reviewed the history of various anomaly <br />89 <br />properties found during the zoning review for consistencies with the <br />90 <br />Comprehensive Plan and a review of the City’s Official Zoning Map, including <br />91 <br />these properties at 3253 and 3261 Old Highway 8. Mr. Paschke summarized the <br />92 <br />process subsequent to a citizen addressing the City Council in July of this year, <br />93 <br />seeking to change the current land use designation of those parcels from the <br />94 <br />existing HDR (High Density Residential) to LDR (Low Density Residential; and <br />95 <br />the City Council’s support for the citizen’s request and directing staff to proceed <br />96 <br />through a process to amend the Comprehensive Plan – Land Use Designation <br />97 <br />accordingly. In reviewing the parcels in conjunction with other parcels, their land <br />98 <br />use designation, zoning, and the highest and best use of those properties, Mr. <br />99 <br /> <br />
