<br /> <br />Community Development Department <br />ph: 651-792-7005 fax: 651-792-7070 <br /> <br />9 May 2006 <br /> <br />Approval of a Side Yard Setback Permit (Section 1013.05 of Roseville City Code) <br />RE: <br /> <br />Dear Roseville property owner, <br />Several South Owasso driveways that were built prior to the adoption of the current code <br />requirements are closer to their side property lines than the code now allows. In light of the <br />regulatory changes that have been made since these lots were improved, some property owners <br />applied for Setback Permits which would return these properties to proper legal standing. These <br />Setback Permit applications requested that the driveways remain in their current locations, and <br />the Setback Permits simply represent an administrative effort to clear up problems created <br />through no fault of the property owners. <br />th <br />On Thursday, May 4, 2006, the Roseville Development Review Committee (DRC) reviewed <br />SIDE YARD SETBACK PERMIT <br />and recommended approval of a to allow the existing <br />driveways of the following properties to remain in their current locations: <br />164 375 433 <br />215 385 585 <br />363 389 625 <br />367 423 2996 Marion Street <br />Comments Regarding Issues at Hand: <br /> No written or verbal comments were received in <br />support or in opposition of the Setback Permit applications. <br />Development Review Committee Recommendation: <br /> Approval of a Setback Permit typically <br />depends on the proposal’s ability to satisfy eight (8) of twelve (12) site conditions listed in the <br />application. Many of the 12 site conditions do not apply to these applications, because the <br />conditions assume that changes are proposed for the site whereas these sites are remaining <br />unchanged. While fewer than 8 of the 12 conditions were satisfied in the majority of the cases, <br />the Setback Permit Review Committee (Deb Bloom, Bryan Lloyd, Jamie Radel, and Thomas <br />Paschke) found that all of the applications satisfied enough of the relevant requirements to be <br />approved. The Committee, therefore, recommended approval all of the Setback Permit <br />applications without imposing any additional conditions for approval. <br />City Planner Decision: <br /> I concur with the recommendations of the DRC to issue the Setback <br />Permits, and, as allowed for in Section 1013.05 of the City Code, make all of the DRC <br />recommendations a condition of approval of the Setback Permits. <br />th <br />After the (ten-day) appeal process has expired at NOON on Monday, May 15, assuming no <br />written appeal has been received by the City Manager, the Setback Permit will be in effect. If an <br />official appeal is properly registered, it will be heard by the Variance Board at the Board meeting <br />th <br />of June 7, 2006, beginning at 5:00pm. <br /> <br />
