EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota, was held on the 10th day of January 2011 at 6:00 <br /> p.m. <br /> The following Members were present: Willmus; Pust; McGehee; and Roe <br /> and Johnson was absent. <br /> Council Member Willmus introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 10871 <br /> A RESOLUTION APPROVING OUTDOOR STORAGE OF DEMOLITION RUBBLE, <br /> AT 2295 WALNUT STREET AS AN INTERIM USE IN ACCORDANCE WITH §1013.09 <br /> OF THE ROSEVILLE CITY CODE (PF10-029) <br /> WHEREAS the property at 2295 Walnut Street is owned by Meritex Enterprises, Inc., <br /> and <br /> WHEREAS, the subject property is legally described as: <br /> SECTION 8 TOWN 29 RANGE 23 THE S 30 FT OF THE W 700 FT OF THE SW 1/4 OF <br /> NW 1/4 AND THAT PART LYING NLY OF WALNUT ST OF THE W 700 FT OF THE <br /> NW 1/4 OF THE SW 1/4 (SUBJ TO ESMTS) IN SEC 8 TN 29 RN 23 <br /> PIN: 08-29-23-32-0004 <br /> WHEREAS, the property owner seeks to allow the existing pile of rubble to remain on <br /> the property with the intent of selling the material during the 2011 construction season; and <br /> WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br /> proposed INTERIM USE on November 17, 2010, voting 5-0 to recommend approval of the use <br /> through July 2011,based on the comments and findings of the staff report prepared for said <br /> public hearing which were found to adequately address the concerns raised by the public as well <br /> as the City's interests; and <br /> WHEREAS, the Roseville City Council has determined that approval of the proposed <br /> INTERIM USE will not result in adverse effects on the public health, safety, and general welfare, <br /> and that it will not impose additional costs on the public if it is necessary for the public to take <br /> the property in the future; <br /> NOW THEREFORE BE IT RESOLVED,by the Roseville City Council, to APPROVE <br /> the proposed INTERIM USE in accordance with Section §1013.09 of the Roseville City Code, <br /> subject to the following conditions: <br /> a. Silt fencing surrounding the rubble pile shall be maintained in proper, functioning <br /> condition for as long as the pile remains; <br /> Page 1 of 3 <br />
