1 <br />2 706.22: SEVERABILITY <br />3 <br />4 <br />5 )OO(.XX: DECLARATION OF POLICY: The health of the trees in the City of <br />6 Roseville is threatened by shade tree pests, and the loss or ill health of trees growing <br />7 upon public and private property substantially depreciates the value of property <br />8 within the city and impairs the safety, good order, general welfare and convenience <br />9 of the public. The provisions of this section are adopted as an effort to control and <br />10 prevent the spread of shade tree pests, in addition to and in accordance with Minn. <br />11 Stat. 89.001, 89.01, and 89.51 -.64. <br />12 <br />13 <br />14 706.01: PURPOSE: This ordinance shall be known as the City of Roseville Urban <br />15 Forest Management ordinance. It is the purpose of this Chapter to protect and <br />16 promote the public health, safety and general welfare of the people of the City by: <br />17 <br />18 A. Regulating the planting, maintenance and removal of trees, shrubs and <br />19 herbaceous plants on all public spaces and rights of way. <br />20 <br />21 B. The permitting licensing of the planting, maintenance, removal and <br />22 trimming of trees, shrubs and herbaceous plants on public lands. <br />23 <br />24 C. The inspecting of trees on public and private lands. <br />25 <br />26 D. The controlling of shade tree pests discisc3 to protect the trees and to <br />27 prevent and abate hazardous conditions and nuisances within the City on <br />28 public and private lands. <br />29 <br />30 E. Protecting and preserving existing healthy trees. <br />31 <br />32 F. Encouraging the planting of trees for the protection and enhancement of <br />33 the environment. (Ord. 1107, 12 -9 -91) <br />34 <br />35 <br />36 706.02: DEFINITIONS: As used in this Chapter, the following words and terms <br />37 shall have the meanings ascribed to them in this Section: <br />38 <br />39 BOULEVARD: That property between the edge of the street and the property line <br />40 (right -of -way line). <br />41 <br />42 Boulevard /Street Tree: Any tree within the boulevard. <br />43 <br />44 City Forester: Park and Recreation Director, or duly authorized employee. <br />45 <br />46 DISEASED TREES: Trees afflicted with Dutch elm, oak wilt or other arboracious <br />47 disccscs identified in the City tree plan. <br />48 <br />49 EASEMENT /RIGHT OF WAY: City owned, non boulevard property. <br />50 <br />51 Hazardous Tree: Any tree, as determined by the City Forester, to cause or have the <br />52 potential to cause harm to city or private property, following the guidelines set forth <br />53 by the MnDNR. <br />54 <br />2 <br />
