Authority of City Forester Horticulturist: The City Forester Horticulturist shall have <br />4 jurisdiction and supervision over all trees, shrubs and herbaceous plants located <br />5 within street right of ways, parks and public places of the City, and to trees, shrubs <br />6 and herbaceous plants and shrubs located on private property that constitute a <br />7 hazard or threat to the public. (Ord. 1107, 12 -9 -91; amd. 1995 Code) <br />8 <br />9 C. Duties of City Forester Horticulturist: The City Forester Horticulturist may direct <br />10 cause the planting, trimming, removal, treatment or other care of any tree, shrub or <br />11 plant of trees on public grounds and may direct thc trimming, removal, treatment or <br />12 other care of any tree, shrub or plant on private property in order to preserve or <br />13 restore its condition or to protect the public from damage or injury. The cost of any <br />14 such work may be assessed against the property on which the tree is located. <br />15 <br />16 D. Street Tree Master PlaRtiftg Plan: In addition to the other responsibilities under <br />17 this Chapter, the City Forester Horticulturist shall review prepare a the Street Tree <br />18 Master Plan Comprehensive Trcc Plan regarding all aspects of trees, shrubs and <br />19 herbaceous plants thc planting of trees on public property within the City and the <br />20 planting of trees on private property that may present a health or safety hazard. <br />21 <br />22 When approved by resolution of the City Council following a review by the City Tree <br />23 Board, the Public Works Director and Community Development Director, the <br />24 Comprchcnsivc Tree Plan and any modifications will bc the Official Plan of the City. <br />25 After the adoption of thc Official Plan, no tree planting permit will bc issued which <br />26 does not conform to thc Trcc Planting Plan. <br />27 <br />28 E. The City Forester may enter upon private premises at any reasonable time for the <br />29 purpose of carrying out any of the duties assigned him or her under this chapter. <br />30 <br />31 <br />32 <br />33 E. <br />34 T REE Pfl A N T INC Pfl Awl C <br />The Street Tree Master Plan Trcc Planting and <br />35 Maintenance Plan shall address the following matters together with any other <br />36 matters deemed appropriate by the City Forester Horticulturist: <br />37 <br />38 1. List of Acceptable Varieties: The list may provide for the planting of certain <br />39 varieties or mixes of varieties in certain locations. <br />40 2. Prohibit planting of specific trees, shrubs and herbaceous plants. <br />41 Specifically prohibited plantings. <br />42 3. Minimum size of plant material. <br />43 4. Grade and quality of plant material. <br />44 5. Method /technique of planting and support. <br />45 6. Maintenance. <br />46 7. Recommended trimming and pruning techniques. <br />47 8. Recommended acceptable treatment.
