14

I don't think we're going to change the need situation as far as
that sewer and water proposal is concerned. There is going to
be a need for it, and fairly soon.

MAYOR DEMOS: The assessment hearing is usually the August
after the completion of all the work which, if this were done in
1981, it would be in 1981. At that point you may claim that you
haven't received sufficient benefits, etc. and we can make an
adjustment at that time, and it would give us time to order it
in and would give us time to work this thing out.

MR. ANDRE: I think the Council could indicate they would
give special review to the problem being discussed at this
hearing, not that they'd be committing themselves.

MAYOR DEMOS: We can make an exception or (inaudible). We
certainly should be able to work something out. It appears
to me there was a lack of forethought in the actual design of sewer
and water way back when.

MR. HONCHELL: No, the street was supposed to go through.

COUNCILMAN CURLEY: Would you object to us ordering it in
and you wait until August following the comPLetion of construction
and we review your assessment at that time? '

MR. WIDERSKI: For the water and sewer - not street or
cul-de-sac. Yes, I'm agreeable to that.

MR. POPOVICH: If you adopt a resolution based on what he
said, you would be ordering that part of the improvement that
calls for sewer and water, and deleting t~e street.

COUNCILMAN CURLEY then introduced the following resolu-
tion and moved its adoption:

Resolution NO.~O

RESOLUTION ORDERING THE CONSTRUCTION
OF IMPROVEMENT NO. SS-W-P-79-20
UNDER AND PURSUANT TO
MINNESOTA STATUTES, CHAPTER 429

BE IT RESOLVED by the Council of the City of Roseville,
Minnesota, that in accordance with the provisions of Minnesota
Statutes 1961, Chapter 429, as amended, the Council held a
public hearing on the proposed construction of Improvement No.
SS-W-P-79-20 consisting of the installation of sanitary sewer and
services, watermain and services, bituminous paving, concrete
curb and gutter, and necessary appurtenances in the general
area of Wagner Street between Woodruff Avenue and Western Street,
and Western Street at Wagner at a cost then estimated at
$66,281.69, and substantially in accordance with the preliminary
