M.Protect and enhance real property values; • <br /> N. Safeguard and enhance the appearance of the City,including <br /> natural amenities of open spaces,hills,woods,lakes,and <br /> ponds; <br /> O. Prescribe penalties for violation of such regulations;and <br /> P. Define powers and duties of the City staff,the City Council, <br /> the Planning Commission,the Board of Adjustment and <br /> Appeals,the Variance Board,the Development Review <br /> Committee,the Administrative Deviation Committee,and <br /> the Master Sign Plan Committee in relation to the Zoning <br /> Code. <br /> 1001.04 Relationship to the Comprehensive Plan <br /> It is the policy of this City that the enforcement,amendment, <br /> and administration of this Code be accomplished with due <br /> consideration of the recommendations and policies contained in the <br /> Comprehensive Plan as developed and amended from time to time <br /> by the Planning Commission and City Council. the City Council <br /> recognizes the Comprehensive Plan as the policy for regulation <br /> of land use and development in accordance with the policies and <br /> purpose herein set forth. <br /> • <br /> 1001.05 Uses Not Provided For Within Zoning Districts <br /> Whenever a use is not specifically permitted in any zoning district <br /> and is determined by the Community Development Department to <br /> not be consistent with a permitted and/or conditional use chart,the <br /> use shall be considered prohibited.In such case,the City Council <br /> or the Planning Commission,on its own initiative or upon request, <br /> may direct the Community Development Department to conduct <br /> a study to determine if the use is acceptable and,if so,what zoning <br /> district would be most appropriate as well as what conditions and <br /> standards should be imposed relating to development of the use. <br /> The City Council,Planning Commission,or property owner,upon <br /> receipt of the Community Development Department's study,may,if <br /> appropriate,initiate an amendment to the Zoning Code/Ordinance <br /> to provide for the particular use under consideration or shall find that <br /> the use is not compatible for development within the City. <br /> 1001.06 Jurisdiction and Authority <br /> A. This chapter is enacted under the authority granted to the <br /> City in State statutes. <br /> • <br />
