1) Yellow Dog Holdings, LLC has submitted application for approval of a pawn <br /> shop as a conditional use at 2057 Snelling Avenue in Roseville, Minnesota. <br /> 2) The subject property has a Comprehensive Land Use designation of Community <br /> Business and a corresponding Zoning Classification of Community Business <br /> District. Section 1005.03 of the Roseville City Code allows pawn shops as a <br /> conditional use in Community Business Districts subject to the provisions of <br /> Section 1009.02C of the City Code. <br /> 3) Section 1009.02C of the Roseville City Code provides that the Roseville City <br /> Council must make the following findings to approve a conditional use: <br /> a. The proposed use is not in conflict with the Comprehensive Plan; <br /> b. The proposed use is not in conflict with any Regulating Maps or other <br /> adopted plans; <br /> c. The proposed use is not in conflict with any City Code requirements; <br /> d. The proposed use will not create an excessive burden on parks, streets, and <br /> other public facilities; and <br /> e. The proposed use will not be injurious to the surrounding neighborhood, <br /> will not negatively impact traffic or property values, and will not otherwise <br /> harm the public health, safety, and general welfare. <br /> 4) The location of the proposed use is near an elementary school, a residential <br /> neighborhood, and other major retail businesses. <br /> 5) Evidence was presented that an existing pawn shop located in the City of <br /> Roseville has had incidents of criminal behavior associated with it, involving the <br /> receipt of stolen items. The number of criminal incidents, averaging slightly fewer <br /> than two per week, is significantly more than other types of businesses and <br /> represents an increase in crime in the area. <br /> 6) Historically, pawn shops have been associated with criminal behavior, which has <br /> led to State and City regulation,but such regulation is not necessarily effective at <br /> deterring certain types of crime, which can lead to an increase in crime in <br /> surrounding businesses and the surrounding area. <br /> 7) The record includes testimony indicating that the close proximity to other retail <br /> establishments can lead to an increase in crime and theft in those establishments, <br /> insofar as the pawn shop provides an outlet for the sale of small items without <br /> serial numbers. <br /> Page 2 of 4 <br />
