4I1) . Not more than 25% of the lot area of each lot may be included in any wetland, which <br /> is below the normal ordinary high water level. (Ord. 1359, 1-28-2008) <br /> B. Controlled Accesses: Lots intended as controlled accesses to public waters or as recreation areas for <br /> use by owners of nonriparian lots within subdivisions shall be allowed only as part of a conditional use•• --- . . - . • - . • - • and shall meet or exceed the following standards: <br /> 1017.16: STRUCTURE DESIGN STANDARDS: <br /> A. Placement of Structures on Lots: When more than one setback applies to a site, structures and <br /> facilities shall be located to meet the most restrictive setbacks. Where structures exist on the adjoining <br /> lots on both sides of a proposed building site, structure setbacks may be altered without a variance to <br /> conform to the average setback of adjoining structures from the ordinary high water level, provided the <br /> proposed building site is not located in a shore impact zone or in a bluff impact zone. Structures shall be <br /> located as follows: <br /> STRUCTURE SETBACKS FROM WATER BODY <br /> Type of Water Body Structure Setback Structure Setback Roads,Driveway,Parking and Maximum <br /> from Water Body from Bluff Other Impervious Surface or Bldg/Structure <br /> Setback Height 4 <br /> MnDNR and City 75 Ft 3 30 Ft. 30 Ft.5 30 Ft. <br /> • Public Waters <br /> Wetland 50 Ft.2'3 Not Applicable 30 Ft.5 30 Ft. <br /> Storm Pond 10 Ft.2'3 Not Applicable 10 Ft. 30 Ft. <br /> 1. Setback is measured from the normal ordinary high water level. <br /> 2. Setback is measured from the wetland or pond boundary. <br /> 3.One water-oriented accessory structure designed in accordance with subsection1017.17C of this chapter may be set back a <br /> minimum distance of 10 feet from the ordinary high water level. <br /> 4. See subsection1017.17G of this chapter. <br /> 5.A 30 foot setback from road or parking surfaces may include a combination of land within rights of way and adjacent to the <br /> right of way,as well as curb and gutter controlling runoff and sediment to a storm pond.Pedestrian trails shall be exempt <br /> from setback requirements. <br /> All other structure setback requirements shall be as stated in the underlying zoning district for each <br /> parcel. <br /> With the exception of regulations in this subsection, fences in bluff impact, shoreland, and wetland <br /> zones shall meet all height and setback requirements of section 1013.021011.08 of this title. Fences <br /> placed on the road side of a lot with water or wetland frontage shall comply with front yard fence <br /> requirements of section 1013.021011.08 of this title.
