• 1017.17: GENERAL DESIGN CRITERIA FOR STRUCTURES: <br /> D. Stairways, Chair Lifts, and Stair and Deck Landings: Stairways and chair lifts shall be used for <br /> achieving access up and down bluffs and steep slopes to shore areas. Stairways and lifts shall meet the <br /> following design requirements: <br /> 1. Stairways and chair lifts shall not exceed four feet in width on residential lots. Wider stairways may <br /> be used for commercial properties, and public open-space recreational properties, an planed unit <br /> developments; <br /> 2. Stair and deck landings for stairways and chair lifts on residential lots shall not exceed 48 square feet <br /> Iin area. Landings larger than 48 square feet may be used for commercial properties, and public open- <br /> space recreational properties, . -: <br /> 1017.19: NOTIFICATIONS TO THE DEPARTMENT OF NATURAL <br /> RESOURCES: <br /> IA. Notice of Public Hearings: Copies of all notices of any public hearings to consider variances, <br /> ordinance amendments, PUDs, or conditional uses affecting a MnDNR designated shoreland district <br /> shall be sent to the MnDNR, Division of Waters Regional Hydrologist and postmarked at least ten days <br /> before the hearings. Notices of hearings to consider proposed subdivisions/plats shall include copies of <br /> the subdivision/plat. <br /> B. Notice of Approval: A copy of approved amendments and subdivisions/plats, and final decisions <br /> I granting variances, PUDs or conditional uses in a MnDNR designated shoreland district shall be sent to <br /> • the MnDNR, Division of Waters Regional Hydrologist and postmarked within ten (10) days of final <br /> action. Procedure: Variances in these overlay districts may only be granted in accordance with Minnesota <br /> Statutes, chapter 462, and Section 1009.04 of this Title. A variance shall not circumvent the general <br /> purposes and intent of this Chapter. No variance shall be granted for a use that is prohibited within the <br /> Izoning district in which the subject property is located. Conditions may be imposed by the City Council <br /> whenin the granting of a variance to ensure compliance and to protect adjacent properties and the public <br /> interest. <br /> B. Notice of Approval: When a variance is approved in a MnDNR designated shoreland district the <br /> City Council after the Department of Natural Resources has formally recommended denial in the hearing <br /> record, the notification of the approved variance required in subsection 1017.19B shall also include the <br /> Board-of-Ad-jostmetWsofficial summary of the public record/testimony,the findings of facts, and <br /> conclusions which supported the issuance of the variance.
