MAYOR DEMOS: Anyone else? Anyone else from Fernwood?
There being none, I will close this hearing.

MR. ANDRE: Mayor, this is a project that requires four votes.

MAYOR DEMOS: I might point out that one of the reasons that
this petition came in at only 31% is that we do take the assessable
feet on the corner lots and add that and we have to have 35% of
the total assessable feet, not home owners. We did have 35% of
the home owners, but not assessable feet. It will take four votes
for passage. The preceding petitions have only required three
because of the percentage of assessable feet.

COUNCILMAN JOHNSON: Mr. Wheaton, can I ask you - did you
go up and down the whole area to get your petition signed?

MR. GARY WHEATON: Yes, I did.

COUNCIL~mN JOHNSON: And you only got 30%? 60% turned you
down?

MR. WHEATON: Not 60% turned me down. I guess about 40%
probably turned me down and the other ones really weren't inter-
ested or never called me back. I went up and down twice, I
believe, to everybody - everybody that I could talk to. I believe
40% said no and about another 20% were kind of riding the fence
and I never went back again. I wanted to get it in and make sure
that it got to the Council.

COUNCILMAN KEHR: Mr. Wheaton, I would like to ask you a
question - what road construction company do you work for?

MR. WHEATON: C. S. McCrossan.

COUNCILMAN KEHR: I would like to ask Mr. Hamernick a ques-
tion. Mr. Hamernick, (inaudible) four houses down, the lower
end of the street there, that are plagued with wet, water - does
that collect in yards?

MR. WHEATON: Wet basements, back yards - every spring when
the frost goes out, every time there's been a heavy rain of an
inch or more - those four or five homes have water in their back
yards. I have pictures to prove it.

COUNCILMAN KERR: Does that water come through because of
the height - does this occur because of the water level
(inaudible) .

MR. WHEATON: The water table comes up.

COUNCILMAN KEHR: Does it come through the basement, through
the windows, or does it come from static water pressure?

MR. WHEATON: Static water pressure. The water table is

up.
