Mr. Boryczka provided a detailed review <br /> pictorially and verbally from his perspective on the changes made to the property <br /> that negatively impacted storm water runoff and flooded his property. <br /> Discussion ensued as Councilmembers and Mr. Boryczka reviewed the documen- <br /> tation provided. <br /> Mr. Boryczka advised that he expected something to be done, whether by the City <br /> Council or through his actions, opining that he didn't cause the problem, but he <br /> planned to do something about it. <br /> Mayor Roe recognized Mr. Borycaka's concerns, and expressed appreciation for <br /> his testimony tonight. <br /> Mr. Ramalingen 3182 Acorn Road <br /> Mr. Ramalingen questioned references to the Tree Preservation Plan; with Mayor <br /> Roe reviewing the Tree Preservation Plan as part of the revised zoning code <br /> adopted in 2010,to be followed by any new developments. <br /> Applicant, Charles Jungmann <br /> Mr. Jungmann provided his perspectives on the two (2) wetland ponds referenced <br /> in Mr. Boryczka's documentation; and their current status and topographical <br /> changes over the years; and actions taken upon his purchase of the property to en- <br /> large one of the ponds following its excavation and increased depth. <br /> At the request of Councilmember Willmus, Mr. Jungmann advised that the pond <br /> excavation (Wetland Pond #2) was done at the direction of the Department of <br /> Natural Resources (DNR)approximately six (6)years ago. <br /> City Engineer Bloom clarified that the action would have been permitted by the <br /> Rice Creek Watershed District, not the DNR. <br /> Further discussion ensued, with references to various letters and documents in the <br /> materials provided by Mr. Boryczka related to the wetlands; a letter addressed to <br /> the property owner at 2182 Acorn Road and dated October 9, 2000, who was not <br /> Mr. Jungmann; Ms. Ramalingen clarifying address changes when the Jungmann's <br /> home was built; and any further correspondence from Rice Creek Watershed Dis- <br /> trict related to the drainage. <br /> Mr. Jungmann advised that he would search for additional correspondence related <br /> to satisfactory completion of drainage work. <br /> Mayor Roe closed the Public Hearing at 9:16 p.m. <br /> City Council Discussion <br />
