Make a determination if the Human Rights Commission would be a more educated and effective Commission if we started to receive all Human Rights Complaints filed by citizens in Roseville. City Council would have to adopt an ordinance giving the Human Rights Commission authority to investigate and mediate Human Rights Complaints in a manner similar to this: Proposed process would be to: First(1)evaluate each complaint initially by online intake form that would ask a series of questions so that the Commissioner could determine if alleged offense is within our jurisdiction.lithe answer is yes(2)then it would proceed to the next step and that would be drafting a charging document and then investigate the complaint to determine if there is probable cause, no probable cause which would result in a dismissal,however if there is probable cause(3)then it would be referred to committee for mediation,if the parties agree to a mutual resolution then that would be the final resolution and close the case.If no agreement could be reached or parties decline mediation then(4)the case would be forwarded to the Minnesota State Department of Human Rights for further review and final disposition with a final report sent to the Human Rights Commission. The Chair is working with the State Department of Human Rights to review this matter and obtain the necessary information needed on a State level to move forward. The Chair has Identified two Commissions that are currently providing a review of complaints and mediation,those cities are Winona and Bloomington. The Chair will consult with both Cities and provide a report on 1)How its working for the Commissions 2)What funding sources they use 3)The type of training they are involved in 4)Pros and cons with a city handling their own complaints Waiting a response from the Commissioner of Human Rights for Minnesota on a available meeting date,there may be a short delay due to a new Administration taking office in January and a new Commissioner being appointed. The Minnesota State Law was changed to allow for the State to refer cases to local Commissions provided there is a City ordinance that authorizes it There are two City Human Rights Commissions that are currently mediating con Special Training would be required of all Commissioners to attend and be certified as a third party neutral. FINANCIAL IMPACT: There will be a undetermined at this time financial impact for training,additional materials, Note: Bremer grants do cover this additional project(civic engagement)grant would have to be written to reflect our procedures. CIVIC ENGAGEMENT~: Approve and implement the district designations to be divided into seven areas to reflect the number of sitting Commissioner's. Chair will assign Commissioner's to Districts.Assignment requests will be strongly considered.To take affect January 2010. FINANCIAL IMPACT: None
