ORDINANCE NO. 1372 <br />AN ORDINANCE AMENDING SELECTED TEXT OF: <br />TITLE 10, CHAPTER 1013 1( 0141, CONDITIONAL USE PERMITS; VARIANCES arrn <br />TITLE 10, CHAPTER ~-1014 ll 0151, ADMINISTRATION <br />THE CITY OF ROSEVILLE ORDAINS: <br />SECTION 1. Purpose: The Roseville City Code, Tile 10, Chapters 1013 (Conditional Use <br />Permits; Variances) and 1014 (Administration) is hereby amended by clarifying and expanding the <br />process of administratively approving minor deviations from Code requirements. <br />SECTION 2. Chapter 1013 is hereby amended as follows: <br />1013.05: 101j 4.05:1 ADMINISTRATIVE <br />DEVIATION: <br />A. Purpose: The purpose of the ~~e~it-administrative deviation allowing limited reductions <br />in building setbacks, driveway setbacks, an.dlor limited excess of impervious coverage is to <br />encourage residents to upgrade and improve their properties, while maintaining the overall <br />character of the community. If any^part of a proposal does not meet the requirements for <br />administrative deviation as established in this section, the entire p~osal shall be ineli ibg le for <br />administrative deviation approval; all impervious coverage and/or encroachments greater than <br />• what is described in this section shall adhere to the variance procedure established in. Section <br />1013.02 of this code, and shall have a demonstrated. physical hardship as defined. by state statute. <br />B. Catenaries of Administrative Deviation: <br />1. Structure Setback Deviation: A structure setback deviation is a reduction of the reauired <br />front, side, and/or rear yard setbacks of principal and/or accessory strictures in either R-1 or R-2 <br />districts. <br />a. A structure setback deviation shall not be allowed for a principal structure less than 20 <br />years old. A e of a principal structure is calculated by subtracting the year in which. the <br />structure was built from the near of application for administrative deviation. <br />b. A structure setback deviation shall not reduce the required front, rear, or corner side yard <br />principal structure setback by more than twenty percent (2U%) or allow a~rineipal structure <br />to be closer than twenty four (24) feet to a front, rear, or corner side property line. <br />c. A structure setback. deviation shall. not reduce the required interior side yard setback for a <br />principal structure by more than seventhpercent 70%) or allow aprincipal structure to be <br />closer than three (3) feet to an interior side propert ~ 1~ ine• <br />d. A structure setback deviation shall not reduce the required. side or rear yard setback for an <br />accessory structure by more than fort percent (40%) or allow an accessory stricture to be <br />closer than three (3) feet to a side or rear pro~rty line. <br />e. Notwthstanding_any of the above requirements. properties granted structure setback <br />deviations under this section shall. not be allowed further encroachments into the reduced <br />setback area as allowed. under subsection 1012.02B of this title. (Ord.. 1223. 6-29-1999) <br />w £ Notwithstanding any of the above requirements, a structure setback deviation shall not <br />allow any structure to be located in a public easement. <br />
