Crepeau, Jr., CounCilmen William Feyerelsen, <br />James Wingert, Charles Crichton. <br />Absent - Councilman Robert WOodburn. <br />Also Present - RepresentatIve Steve Novak, Attorney James Lynden, <br />Treasurer RIchard O'Kelly, Clerk AdminIstrator Charlotte <br />MCNiesh, Deputy Clerk Dorothy Zehm. <br /> <br />Approval of MInutes <br />Feyerelsen moved, seconded by Wingert, that the Minutes of the Councl I <br />Meeting of January 13, 1975, be approved as amended. Motion carrIed <br />unanimously. <br /> <br />BUSINESS FROM THE FLOOR <br /> <br />Representative Steve Novak <br />Representative Novak expressed his desire to work with Arden Hills <br />and the other municipalities in his distrIct, to help solve prObleMs. <br />He offered to meet wIth the Arden Hills Council to discuss the <br />variety of pending legislation and 'oeal needs. He specifIcally agreed <br />to aid the Village In Its communications wIth the State Highway <br />Department and to report the status of a recently IntrodUced bIll re <br />the "open meeting law". <br /> <br />ROlJe r Re I I I ng <br />Mr. ReIling explained that he desires to remodel hIs grocery store <br />and SerVice station at 3151 Lake Johanna BOUlevard, and he revlewad <br />three optIons which Attorney Lynden had suggested might be pursued: <br /> <br />I. To provide proof to Council that the non-conformIng <br />use of the service station had not ceased for one year. <br />2. To apply for rezoning of the property to R-S, and for a <br />Special Use Permit for an automobile service station, <br />and for a license under Ord. No. 132. <br />3. To abandon In place, or remove, the underground tanks <br />pursuant to Ord. 132. <br /> <br />. <br /> <br />Reiling said that he described the proposed remodeling plans at a <br />December 1973 Council meeting; stating he Could not get gas, because <br />of the gas shortage~ startIng In about June of 1973; but he continued <br />to repair autos until nearly the end of 1973. He said he also rented <br />trailers, which he considers to be an auxtllary use of a servIce sta- <br />tIon, and that he used the tanks to store fuel 011 when gas was not <br />available. He saId that when gas became available agaIn, about July <br />of 1974, he ordered gas, and now has gas in the tanks, but no license <br />to operate the statIon. Reiling explained that In hIs proposal to move <br />the grocery, within the confines of the building, he had never en- <br />visioned not having the gas station also. <br /> <br />In dIscussion, It was noted that option No.2, to request rezoning to <br />R-S and then to request a Special Us~ PermIt for the servIce station, <br />could not be utilized because of the close proximIty of the station <br />to a pUblic School COrd. 132, Sec. 3). <br /> <br />After diSCUSSion, the matter was referred to the Board of Appeals for <br />Its recommendations to the Council. <br /> <br />REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> <br />Case No. 74-36 C.
