Crepeau, Jr., Councilmen Charles Crichton, <br />Stan Olmen, William Feyereisen, James Wingert. <br />Absent - None. <br />Also Present - Attorney James Lynden, Engineer Donald Lund, Treasurer <br />Richard O'Kelly, Parks DIrector John Buckley, Clerk AdmInis- <br />trator Charlotte McNlesh, Deputy Clerk Dorothy Zehm. <br /> <br />-. <br /> <br />ADDro~al of Minutes <br />The Minutes of the Regular Council Meeting of March II, 1974, were <br />-approved as amended. <br /> <br />Buslnes~ from the Floor <br />None. <br /> <br />REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> <br />Ca e No 72-35 Pemtom Inc. - Final Plat Townhouse Villa €IS at <br />Arden Hills - Sixth Addlt on <br /> <br />Attorney Lynden referred the Council to his letter of 3/22/74, noting <br />several questions re the performance and guarantee bond obligations <br />of Pemtom. <br /> <br />After discussion of the bonding requirements, the matter was referred <br />to Attorney Lynden, Engineer Lund, Attorney Hermann and J~mesAHIII to <br />resolve...... i- neeaFda"~6 ...ith aeVele13Jfl8Rt :a~f"aelReAts.~ ~~. <br /> <br />Attorney Lynden said that he finds the Final Plat, Development Agree- <br />ment and Open Space Easements and Covenants for Addition 6 to be in <br />order. <br /> <br />Wingert moved, seconded by Olmen, that the Councl I approve the Develop- <br />ment Agreement for Townhouse Villages at Arden Hills, Sixth Addition, <br />and authorize Its execution by the Mayor and Clerk Administrator, on <br />behalf of the Vi Ilage. Motion carried unanImously. <br /> <br />Wingert moved, seconded by Feyerelsen, that the Councl I approve the <br />Open Space Easements and Covenants, Townhouse Villages at Arden Hills, <br />Sixth AdditIon, on the condition that the same be registered in the <br />office of the Ramsey County Registrar of Titles contemporaneously <br />wIth the registration of the Final Plat for the 6th Addition. <br /> <br />,... <br /> <br />In discussion re Village access to al I uti Ilties, Engineer Lund said <br />that hIs office Initially checked the entire layout for access to all <br />utilities, advisIng that utility construction plans Indicate that all <br />utilities run In easement areas and are accessible by paved streets. <br />Attorney Lynden advised that the provision for Village access t? ~_ <br />Ji~~.2tl;s covered by the !;)Il".' QfH1l6nt P 3rr;>lImaAt5~ -H<,/ ~ <br /> <br />Wingert moved, seconded by Crichton, that the Council approve the Final <br />Plat, Townhouse Villages at Arden Hills, Sixth Addition, and authorize <br />. the Mayor and Clerk Administrator to execute same on behalf of the <br />Vi I lage, after Attorney Lynden examines the Registered Property Abstract <br />and renders a title opinion finding that the tract to be platted as the <br />6th addition Is owned by Pemtom, Inc., and subject to Attorney Lynden's <br />approval of necessary bonds. Motion carried unanimously. <br /> <br />REPORT OF VILLAGE ENGINEER DONALD LUND <br /> <br />Arden Mqnor <br />Engineer Lund submitted Suburban Engineering's Inspection Report #6, <br />dated 3/21/74, advising that the pond excavation has started and that <br />uti Ilty construction Is to start this week. <br /> <br />-1- <br />
