Crepeau, Jr., Councilmen James Wingert, <br />Charles Crichton, Robert Woodburn, Ward Hanson. <br />Absent - None. <br />Also Present - Engineer Donald Christoffersen, Treasurer Donald Lamb, <br />Police Lieutenant Douglas McCall, Planner Orlyn Miller, <br />Clerk Administrator Charlotte McNiesh, Parks Director John <br />Buckley (about 9:45 p.m.), Deputy Clerk Dorothy Zehm. <br /> <br />Approval of Minutes <br />Wingert moved, seconded by Crichton, that Council approve the ~Inutes <br />of the Regular Council Meeting of April 25, 1977, and the Special <br />Council Meeting of May 2nd, 1977, as amended. Motion carried unani- <br />mously. <br /> <br />Business from the Floor <br />Case No. 77-18. Lot Spilt <br />Mr. and Mrs. Carl Elmquist, 1300 Ingerson Road, requested Council <br />to consider their application for lot spilt; explained they were not <br />able to attend the Planning Commission Meeting to answer the Commis- <br />sion's concerns) want to mortgage the property, but desire the lot <br />spilt before they apply for the mortgage. <br /> <br />Wingert referred Council to Planner Miller's report, and attached <br />sketch of proposed spilt; reported that the Planning Commission was <br />concerned re use of the 25' wide access to the ~ake - suggested that <br />the same access could be provided by establishing an easement with <br />restrictions for Its use) explained that the Planning Commission <br />did not act on the request because the members could not satisfy <br />themselves of the proposed use, especially concerned re possible <br />public use of lake access. <br /> <br />Elmqulsts explained that they Intend to build on the newly created <br />street lot) want the access to the lake for their own use; propose <br />TO sell the existing house. <br /> <br />Crlchlcn noted that the proposed lake lot (on which existing house Is <br />lOcated) will not be 40' wide at the buIlding setback line as required <br />by Ordinance. <br /> <br />Woodburn said that lake usage Is already heavy In this area) ,feels <br />the lot spilt will add to the "tanglement"; privacy should be retained <br />for the adjacent property owners) additional access provides oppor- <br />tunity for nuisance. <br /> <br />After discussion, Wingert moved that Counci I approve the 1'.:>-" split <br />as requested, granting the variance In lot width at the setback line <br />on the western lot. Motion was seconded by Hanson. <br /> <br />After further discussion, Crichton moved to refer the application <br />back to the Planning Commission for Its recommendations to Council; <br />motion was seconded by Woodburn. Motion did not carry (Crichton, <br />Woodburn voting In favor of the motion; Wingert. Hanson, Crepeau <br />voting In opposition). <br /> <br />After further discussion, Hanson moved to amend the previous motion <br />to approve the lot split, adJusting the lake front to spilt It equally <br />betwaun tile two lots for a distance of 25' fro. the shore (either <br />flagged or squared). Motion as amended carried (Hanson.
