~ ORDINANCE NO. 155 STATE OF MI NN ESOTA COUNTY OF RAMSEY VILLAGE OF ARDEN HILLS AN ORDINANCE AMENDING ORD. NO. 98, THE SUBDIVISION AND PLATTING ORDINANCE, TO ADD A PROVISION EXEMPTING CERTAIN SU8- DIVISIONS. The Council of the Village of Arden Hills does hereby ordainas follows: Section 1 Amending Provision. Ord. No. 98, regulafing the subdivision and platting of land in the Village of Arden Hills, is hereby amended in the following respecTs: 1. The caption of Section 13 is hereby amended to read "Variances and ExempTions." II. The following is added as Paragraph (D) of said SecTion 13: (D) In the case of a subdivisian of small size and of minor importance, situated in a locality where con- diTions are well-defined, the Village may exempt the subdivider from complying with some of the requirements of this ordinance. In ihe case of a requeSt to divide a IoT which is a part of a recortled plat or a parcel of record prior To the effective date of ihis Or- dinance (April 6, 1967), where the division is to permiT the adding of a parcel of land to an abutting parcel or to create two or more parcels and the newly-created property line will not cause the remaining portions pf the parcel To be in violation of this ordinance or the Zoning Ordinance, the division may be approved by the Village Council. AT the option of the Council a survey by a regisTered land surveyor showing the original parcel and the proposed division shall be submitted, but no other requiremenis of This ordinance shall apply. In addition to the foregoing exemption, exemptions from the provisions of this Ordinance may be granTed by the Council in the insTance of the division of one or more parcels as referred To in the previous paragraph into one or more separately described tracTs, and exemptions may similarly be granted from the provisions of this ordinance in instances of the c4n- solidation of two or more parcels as aforesaid, or paris Thereof, inTO Two or more iracis, but in the case of granting such exemptions the Council shall find com- pliance with the following conditions: 1. The owner or owners of such parcel or lots to be so divided shall file with the Adminisiralor a proposed : survey plat by a registered land surveyor of the IoT pr lots to be divided or consolidated. Such plat or survey shall showihedimensions of said IoTS as measured upon the recorded plat, and also the proposed division Thereof. A written description of the separately described tract or tracTS which wili resulT from the proposed subdivision or consolidation shall be filed with such plat or survey and 2. The separately described tract of land to be con= veyed or designated for building permit purposes by reason of such division or consolidation as described upon said proposed plat, shall not be less ihan the minimum dimensions required to secure the minimum IoT area specified in the Zoning Ordinance. 3. As a result of such division or consolidaTion as herein authorized, no remaining parT of an origfnal subdivision lot or parcel shall become a separately described Iot upon saitl proposed plat with a size less than the minimum dimensions required to secure the minimum lot area specified in the Building and Zpning . Ordinance. - A filing fee of $5.00 shall be paid the Clerk- Adminisirator with every request for a variance or exempTion hereunder. Section 2 Effective Date.
