CITY OF CENTERVILLE <br /> CITY COUNCIL SPECIAL MEETING MINUTES <br /> May 1, 2018 <br /> 6:30 p.m. <br /> Pursuant to due call and notice thereof, the City of Centerville held a Special City Council <br /> meeting of May 1, 2018 at City Hall, 1880 Main Street. <br /> PRESENT: Mayor Jeff Paar <br /> Council Member Russ Koski <br /> Council Member D. Love A pp r o N' a d <br /> Council Member Matt Montainll 1, <br /> ABSENT: Council Member Steve King <br /> STAFF: City Administrator/Engineer Mark Statz <br /> COUNCIL MEETING <br /> L CALL TO ORDER <br /> Mayor Paar called to order 6:30 p.m. <br /> II. NEW BUSINESS <br /> 1. Sale of 2065 Commerce Drive <br /> a. Administrator Statz explained that Mr. & Mrs. Pederson desired to purchase the property <br /> through a limited liability corporation rather than themselves. He stated that at Council's <br /> meeting of April 25, 2018 they approved Res. #18-004 which sold the property to the <br /> Pederson's and to rectify the City's oversight the propose Res. #18-05 would need to be <br /> adopted as submitted. <br /> Discussion ensued regarding whether or not the second "Whereas" clause of the <br /> presented resolution was correct, due to the fact that it states that the City is going to sell <br /> the property to "...Jon R. Pederson and Sophie Pederson, husband and wife, acting as <br /> individuals;..." Without the attorney being present, the Council attempted to allow some <br /> flexibility for the attorney to make a change in that whereas clause if it turned out that it <br /> was indeed, incorrect. Therefore the following motion was made: <br /> Motion by Council Member Montain, seconded by Council Member Love to Adopt <br /> Res. #18-05—Authorizing Conveyance of Real Property to Jon and Sophie Pederson <br /> and Assignment to Ruffrike-Johnson 1031, LLC as presented or as amended after <br /> review of the second "Whereas" clause bythe City Attorney. The allowed <br /> amendment by the City Attorney, under this motion would be restricted to the issue <br /> of the stated buyer in the second "Whereas" clause. All in favor. Motion carried. <br />
