EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 23rd day of July 2001, at 6:30 p.m. The following members were present: Mastel, Maschka, Kysylyczyn, Klausing, and Goedeke and the following were absent: None Council Member Kysylyczyn introduced the following resolution and moved its adoption: RESOLUTION NO. 9908 A RESOLUTION APPROVING A TWO FOOT VARIANCE FROM SECTION 10071012.02B2 OF THE ROSEVILLE CITY CODE FOR PROPERTY LOCATED AT 222 NORTH MCCARRONS BOULEVARD (PF 3321) WHEREAS, Amy and Gregg Peterson have requested a two foot variance from Section 1012.02B2 of the Roseville City in order to replace an existing fence to a heigh of six fee in the front yard; and WHEREAS, the Peterson property is located at 222 North McCarrons Boulevard and legally described as: That part of Lot 32, Thorntons Subdivision of the Northeast ~ of Section 13, Township 29, Range 23, lying northerly of a line 217.00feet north of the most southerly line of said Lot 32 and its westerly extension, as measured at right angles thereto and parallel with said moth southerly line, and lying east of the west 85.00 feet thereof, according to the recorded plat thereof(PID # 132923140041) WHEREAS, Section 1012.02B2 of the Roseville City Code requires only a fence 48 inches (four feet) in height in a front yard; and WHEREAS, the front yard of a home is determined to be that area that lies from the front property line to the front line of the principal structure; and WHEREAS, the Peterson request desires a variance to construct a six foot tall fence a minimum of three feet from the front property line; and WHEREAS, the Roseville Planning Commission held a public hearing regarding the Peterson variance request and recommended (7-0) to approve the request, based on findings outlined in Section 4 of the project report dated 7/11/01. 1
