<br />1 <br /> <br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br /> <br />DATE: 1-22-96 <br />ITEM NO: G-2 <br /> <br />Agenda Section: <br />e- Hearin <br /> <br />SNOW REMOVAL, DELIVERIES, TRASH REMOVAL <br />NOISE AT MAJOR PARKING LOTS <br /> <br /> <br />Bac~round: <br /> <br />The COWlcil asked at their October 23, 1995 meeting that the staff review the <br />existing standards for deliveries, snow plowing, and rubbish pick-up within the City <br />Code. After reviewing the codes, the staff was to confer with the Planning <br />Commission (the Commission has submitted comments in November). The COWlcil <br />continued its hearing on this issue to January 22, 1996. COWlcil members have <br />received complaints regarding the late night/early morning noise, headlights, and <br />truck deliveries. (City computer records show no more than 5 in anyone year.) <br /> <br />There are a number of alternatives. The staff offers three alternatives as possible <br />Code amendments and suggested that the Planning Commission review them and . <br />other alternatives suggested by the public heaTing participants. The Commission <br />sent comments (attached from November 8th meeting) back to the City COWlcil. <br /> <br />A major concern of the Commission was that regulating the hours of snow plowing <br />will greatly infringe on the available parking and practical uses of the parking lots <br />throughout the city such as retail centers, office complexes, schools, and churches. <br />Trash removal and deliveries may be easier to control. The Commission expressed . <br />concern about the method and quality of code enforcement (police normally do <br />these enforcement activities after 4:30 pm) over this issue. <br /> <br />The proposed amendment is to Section 405.03 (Noise Control) of the City Code, <br />wherein refuse handling is regulated and permitted only from 7 :00 am to 10:00 pm <br />on weekdays and 9:00 am to 9:00 pm on weekends in residential districts only. <br />Section 405.02D states only that W1loading cannot create excessive noise. <br />
