This is an unfortunate and regrettable situation, <br />a situation that Ryan Construction Company has not been in before. <br /> <br />The purpose of this correspondence is to inform the City Council of what led to this unfortunate <br />event, and to insure you that we are doing everything possible to remedy the situation. <br /> <br />The City of Roseville did issue to Ryan Construction Company all appropriate permits for the <br />commencement of construction of the Twin Lakes - Phase IV building. The City's issuance of <br />these building permits was based on conformance of the building with Minnesota Building Code <br />Regulations. The City also informs every applicant of the need to obtain other related permits, <br />but does not issue the building permit contingent on the applicant receiving all of these related <br />permits. The Twin Lakes - Phase IV building meets all of the Minnesota Building Code <br />Regulations and City Zoning Codes, therefore the City of Roseville staff was acting <br />appropriately when the project was issued a building permit. The City did not confer on Ryan <br />Construction Company any special treatment in issuing the building permit for the Twin Lakes - <br />Phase IV building. <br /> <br />To date, Ryan Construction Company has not received a permit from the Rice Creek Watershed <br />District for the constructiQn of the Twin Lakes - Phase IV building. Our consultants have been <br />working with the Watershed District since early July of this year in an effort to coordinate the <br />design of an on-site stormwater pond in conjunction with the City's efforts to construct an off-site <br />regional pond. During this process our consultant failed to submit to the Rice Creek Watershed <br />District the appropriate application materials that officially started the review process. This <br />material was not officially submitted to the Watershed District until August 20th.
