BACKGROUND. <br /> <br />2.1 Martin O'Connor owns a home at 1972 Fairview Avenue North. The property is <br />zoned R-1 Single Family Residential and adjacent land uses are single family <br />residential to the north, south, east, and west. <br /> <br />2.2 Mr. O'Connor is requesting a variance from Section 703.04(8)(9), City Code, to <br />reduce the setback of a driveway to less than five feet in order to allow the <br />continuance and replacement of a driveway and parking area adjacent to the <br />garage. The existing black top driveway was in need of repair and recently replaced <br />with a concrete driveway. During the permit review process, it was brought to Mr. <br />O'Connor's attention that the driveway was not in compliance with the requirements <br />of the City Code. Mr. O'Connor recalls getting permission from the adjacent <br />property owner to install the parking space next the garage many years ago; <br />however, there is no variance on record for this property. In order to bring the <br />driveway into compliance, Mr. O'Connor is now requesting a minor variance. <br /> <br />2.3 It is the policy of the City of Roseville to grant minor variances for driveway side <br />yard setbacks when nonconforming driveways are replaced, provided the property <br />is located in an R-1, Single Family Residential District, and used for residential <br />purposes. <br /> <br />2.4 Section 703.04(8)(9), City Code, states "residential driveways shall be constructed <br />so that the edge of the driveway nearest to the side lot line shall be a minimum of <br />five feet from the side lot line." <br /> <br />PF#3011 - RCA (05/26/98) - Page 1 of 2 <br />
