<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br />DATE: OS/24/04 <br />ITEM NO: <br /> <br />Department Approval: <br />DPWfDM/RT <br /> <br />Item Description: <br /> <br />City Manager Approval <br /> <br />Agenda Section: <br />REPORT <br /> <br />Report on Nuisance Code Violations at 1992 Cleveland Ave. <br /> <br />1.0 REQUESTED ACTION: <br /> <br />Council action is necessary to resolve a City Code violation at 1992 Cleveland Ave. The property is owned <br />by Mr. Seth Eggessa. The staff has been working on this case for over two years. The owner has <br />completed most of the work necessary to bring the property into compliance except for one violation that, <br />if left uncorrected, would adversely affect the adjoining property to the north. The owner has been notified <br />of this agenda item and Council meeting by ccrtified mail as required in City Code Section 407.06E. <br /> <br />2.0 Project History <br /> <br />2.1 The home at 1992 Cleveland Ave. is occupied by Mr. Eggessa. <br /> <br />2.2 Original code compliance items at the property included: <br />1. The construction of a deck onto the front of the home which was completed ~f1.~I the city sent <br />notice (June 23, 2003) to Mr.Eggessa that a pem1it was required for decks and construction should <br />stop (City Code Section 901.01 and Section 104.2.4 of the 1997 U.B.C.). <br />2. The construction of a new, enlarged, driveway with a gravel surface. Mr. Eggessa was notified <br />(May 20, 2003) that permits are required for driveway construction and that approved surfaces are <br />asphalt, concrete or pavers. <br />3. Building materials such as plywood, corrugated metal, wood truss-joists and plastic buckets were <br />stored on both the east and west sides of the garage (City Code Sections 407.02 D, 407.02 M and <br />407.03 H). <br />4. Several piles of cut logs and accumulated brush were located throughout the property including on <br />the west, south and east sides of the garage and along the easterly property line (City Code <br />Sections 407.02 D and 407.03 G). <br />5. A drainage swale, required as a condition when an addition was added to the home in 1999, was <br />incomplete and it encroached upon the adjoining property to the north (City Code Section 901.01 <br />and U.B.C. Section 108.4). <br />6. Vegetation in excess of 8" (City Code Section 407.02 C). <br /> <br />2.3 At the July 21 5t 2003 City Council meeting the Council allowed Mr. Eggessa approximately two <br />months, until the September 15th Council meeting, to correct City Code violations before it would <br />consider possible abatement action or the issuance of a court citation. Staff met with Mr. Eggessa <br />and Mr. Gilbertson after this meeting. <br /> <br />2.4 At the September 15th City Council meeting staff reported that most of the violations had been <br />corrected by Mr. Eggessa and recommended continuing the abatement process and review through <br />October 13th, 2003 in order to allow Mr. Eggessa additional time. <br /> <br />2.5 10-13-2003 status of code compliance items: <br />1.
