EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota, was held on the 22nd day of October 2012 at 6:00 <br /> p.m. <br /> The following Members were present: Willmus, Johnson, Pust, McGehee, Roe; <br /> and none were absent. <br /> Council Member Johnson introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 11019 <br /> A RESOLUTION APPROVING A DRIVE-THROUGH FACILITY AS A <br /> CONDITIONAL USE AT 2700 LINCOLN DRIVE (PF12-018) <br /> WHEREAS, Semper Development has applied for approval of the proposed conditional <br /> use in conjunction with HarMar, Inc., owner of the property at 2700 Lincoln Drive,which is <br /> legally described as: <br /> PIN: 04-29-23-44-0030 <br /> Slawik Park Addition No. 4, subject to easement,Lot 1 through Lot 4, Block 1 <br /> WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br /> proposed CONDITIONAL USE on October 3, 2012, voting 6-0 to recommend approval of the use <br /> based on the comments and findings of the staff report prepared for said public hearing; and <br /> WHEREAS, the Roseville City Council has determined that approval of the proposed <br /> CONDITIONAL USE will not result in adverse impacts to the surrounding properties based on the <br /> following findings: <br /> a. While a drive-through facility doesn't appreciably advance the goals of the <br /> Comprehensive Plan aside from facilitating continued investment in a property, it <br /> does not conflict with the Comprehensive Plan; <br /> b. The proposed use is not in conflict with a Regulating Map or other adopted plan <br /> because no such plans apply to the area surrounding the property; <br /> c. The proposed use is not in conflict with City Code requirements since permits will <br /> not be issued if the plans fail to meet all of the relevant requirements and, <br /> moreover,the conditional use approval can be rescinded if the use or the property <br /> fails at any time to comply with all applicable Code requirements or conditions of <br /> the approval; <br /> d. The property has been a restaurant for many years, which generates significantly <br /> more traffic than the proposed drive-through pharmacy window—especially <br /> during evening hours and weekends, so the proposal is not expected to intensify <br /> any practical impacts on parks, streets, or public infrastructure; <br /> Page 1 of 3 <br />
