EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, <br /> County of Ramsey, Minnesota, was held on the 7 h day of May, 2018 at 6:00 p.m. <br /> The following Council Members were present: McGehee, Willmus, Laliberte, Etten and Roe; <br /> and none were absent. <br /> Council Member Laliberte introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 11511 <br /> A RESOLUTION APPROVING A CONDITIONAL USE PURSUANT TO §1009.02.0 AND <br /> §1009.02.D. 12 OF THE CITY CODE FOR CHICK-FIL-A AT THE HARMAR MALL (PF18-005) <br /> WHEREAS, City Code §1009.02.0 establishes general Conditional Use (CU) criteria that is <br /> required to be met by a CU proposal; and <br /> WHEREAS, §1009.02.D. 12 establishes specific CU criteria for a drive-through that is also <br /> required to be met; and <br /> WHEREAS,the property at is legally described as: <br /> (legal description to be provided in execution copy) <br /> AND WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br /> proposed CU on March 7, 2018, voting 6-0 to recommend approval of the CU to permit the installation of <br /> a drive-through at the Chick-fil-A pursuant to §1009.02.0 and §1009.02.D.12 of the City Code based on <br /> the following findings: <br /> GENERAL CONDITIONAL USE CRITERIA: §1009.02.C: <br /> a. The proposed use is not in conflict with the Comprehensive Plan. While a drive-through facility <br /> doesn't appreciably advance the goals of the Comprehensive Plan aside from facilitating continued <br /> investment in a property, Planning Division believes that it does not conflict with the Comprehensive <br /> Plan. <br /> b. The proposed use is not in conflict with a Regulating Map or other adopted plan. The proposed use is <br /> not in conflict with such plans because none apply to the property. <br /> c. The proposed use is not in conflict with any City Code requirements. Aside from the variance to <br /> §100505.E, Frontage Requirement, Planning Division staff believes that the proposed drive-through <br /> facility can and will meet all applicable City Code requirements; moreover, a CONDITIONAL USE <br /> approval can be rescinded if the approved use fails to comply with all applicable Code requirements or <br /> any conditions of the approval. <br /> d. The proposed use will not create an excessive burden on parks, streets, and other public facilities. The <br /> City staff does not expect the proposal to intensify any practical impacts on parks, streets, or public <br /> infrastructure. There may well be a slight increase in traffic, however,this traffic is anticipated to be <br /> primarily interior and not significant, nor impactful to the adjacent public roadway system. That said, <br /> the City is requiring a traffic study to better document the impact, or lack of significant impact, to the <br /> operation of the signal at Snelling and the mall entrance. City staff is not anticipating any significant <br /> impacts to this intersection and plan to pass the findings on to the City Council as a component of the <br /> RCA. <br /> Page 1 of 4 <br />
