<br />CITY OF ROSEVILLE <br />ORDINANCE NO. 1309 <br /> <br />AN INTERIM ORDINANCE ADOPTING A DEVELOPMENT MORATORIUM FOR <br />PROPERTIES LOCATED WITHIN THE TWIN LAKES MASTER PLAN AREA <br /> <br />THE CITY OF ROSEVILLE ORDAINS: <br /> <br />SECTION 1. Purpose. The City ofRoseville ("City") has established a Twin Lakes <br />Stakeholders Task Force to review and make recommendations on revisions to the Twin Lakes <br />Master Plan. The City and the Master Developer are (or will be) conducting studies and will <br />schedule hearings for the purpose of considering amendments to the Comprehensive Plan, <br />Zoning Section of the City Code and the Twin Lakes Master Plan. <br /> <br />A. Pending the completion of the planning studies and the adoption of amendments to its <br />Twin Lakes Master Plan by the City and/or the Master Developer, the Roseville City <br />Council determines that it is in the public's interest to impose a development <br />moratorium on the receipt of and processing of requests for building permits <br />(excluding the Master Developer and Twin Lakes Master Plan Amendment, and <br />except as described in Section l.B, below), rezoning, conditional use permits, <br />variances and subdivision of land within the Twin Lakes Master Plan area as <br />identified by the attached property identification numbers and/or the attached map <br />and in the 2002-3 Comprehensive Guide Plan. The term subdivision as used herein is <br />the separation of an area, parcel or tract ofland under single ownership into two or <br />more parcels, tracts, lots or long term leasehold interests, except those separations <br />specified in Chapter 462.358, Subd. 4 of Minnesota Statutes and any amendments <br />thereto. <br /> <br />B. Construction activity within an existing structure or site, which provides for usability <br />of the existing building or site, life safety and access doors or docks improvements or <br />maintenance repairs, including exterior building and site modifications and <br />improvements, which do not extend the basic building footprint, will be permitted <br />provided that such improvements are undertaken in compliance with the City's <br />Comprehensive Guide Plan, Official Controls and Building Code Regulations. <br /> <br />C. For the past five months, the City has received numerous inquiries from property <br />owners and developers regarding the possible future redevelopment of this area. <br />Development inquiries and/or proposals include elementary schools, high density <br />residential, including apartments, retail, office and industrial-trucking activities. <br /> <br />D. The City recognizes that the development or redevelopment of this area is challenging <br />due to the number of property owners involved, adjacent land uses and access issues. <br />The intent of this moratorium is to provide the City and the Master Developer a <br />reasonable period of time to review existing land use and development plans, and <br />prepare applications and permits, policies and pro actively plan for any future <br />development in the area. During the moratorium period, the City will continue the <br />planning process to review land use plan and objectives, work with existing property <br />owners, and consultants, and receive input from the surrounding neighborhood. <br /> <br />1 <br />
