<br /> <br />Variance Board Meeting <br />City Council Chambers, 2660 Civic Center Drive <br />Draft Minutes - Wednesday, September 05, 2007 <br />1. Call to Order <br />Chair Daniel Boerigter called to order the Variance Board meeting at 5:32 p.m. and reviewed <br />the role and purpose of the Variance Board. <br />2. Roll Call & Introductions <br />City Planner Thomas Paschke called the Roll. <br />Members Present: Chair Daniel Boerigter; and Commissioners Barbara Martinson and Jim <br />Doherty. Commissioner Thomas Gottfried was also present in the audience. <br />Staff present: City Planner Thomas Paschke; and Associate Planner Bryan Lloyd. <br />3. Approval of Minutes <br />MOTION <br />Member Doherty moved, seconded by Member Martinson, to approve meeting minutes <br />of August 1, 2007 as presented. <br /> Ayes: 2 <br />Nays: 0 <br />Abstentions: 1 (Boerigter) <br />Motion carried. <br />4. Public Hearings <br />a. PLANNING FILE 07-049 <br />Request by Nicholas King, 1728 Lindy Avenue, for a VARIANCE to Roseville <br />City Code, §1012 (General Requirements) to allow a fence that is taller than the <br />Code permits along the rear and side property lines. <br />Chair Boerigter opened the Public Hearing for Planning File 07-049. <br />Associate Planner Bryan Lloyd reviewed the request of Mr. and Mrs. King, to allow <br />construction of a fence greater than 6.5 feet tall on their residential property. Mr. <br />Lloyd advised that retail properties abut the applicants’ property to the east (Lexington <br />Plaza Shoppes) and south (Arthur’s Jewelers); and along with the Kings’ desire for <br />increased privacy and security prompting the variance request. <br />Mr. Lloyd advised that new commercial developments are required by City Code to <br />have an eight foot (8’) privacy fence to screen adjacent residential properties, and the <br />Building Official was able to require that height requirement at Lexington Plaza <br />Shoppes. However, Mr. Lloyd noted that, regulatory tools didn’t compel Arthur’s <br />Jewelers property to install a similar fence it not seeking other approvals. Mr. Lloyd <br />noted that the additional height would serve the purposes of the King’s while providing <br />uniformity in appearance. <br />Staff recommended APPROVAL of a 1.5 foot VARIANCE to Roseville City Code, <br />§1012.02B(3) (Legal Encroachments) to allow to allow a fence that is taller than the <br />Code permits along the rear and side property lines; based on the comments and <br />findings of Section 5 and the conditions of Section 6 of the project report dated <br />September 5, 2007. <br />The applicant was present, but had no comment. <br />Chair Boerigter closed the Public Hearing, with no one appearing for or against. <br /> <br />
