EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOA OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 6~' day of July, 2005, at 5:00 p.m. <br />The following members were present: Chair Bakeman and Members Pust, Doherty, and <br />Boerigter <br />Variance Board Member Bakeman introduced the following resolution and moved its adoption: <br />VB RESOLUTION N0.20 <br />A RESOLUTION APPROVING AN 11.5 FOOT VARIANCE TO SECTION 1004.01E <br />(PRE-EXISTING SETBACK) AND AN 18 FOOT VARIANCE TO SECTION 1004.016 <br />(RESIDENTIAL DWELLING DIMENSIONS -REAR YARD SETBACK) OF THE <br />ROSEVILLE CITY CODE FOR ARNOLD REHMANN, 44 MID OAKS LANE (PF3653) <br />WHEREAS, Arnold Rebmann has requested a VARIANCES to Section 1004 of the <br />Roseville City Code to allow construction of a living area (master bedroom) addition on to the <br />home that encroaches into the required corner side yard and rear yard setbacks; and <br />WHEREAS, this property is addressed as 44 Mid Oak Lane and legally described as: <br />I.ot 1, Block 2, ld Oaks <br />PIhT 16-29-23-14-0082 <br />WHEREAS, Section 1004.01E (Pre-Existing Setback) requires a minimum setback <br />adjacent to Mid Oak Lane of 40 feet based on the pre-existing location of the Rebmann home and <br />the other homes in the neighborhood; and <br />WHEREAS, the existing principal structure is set back 42 feet from the property line <br />adjacent to Mid Oaks Lane and the proposal by Mr. Rebmann seeks to construct the addition <br />28.5 feet from the property line or an 11.5 foot encroachment; and <br />WHEREAS, Section 1004.016 (Residential Dwelling Dimension -Rear Yard Setback) <br />requires a structure to be set back a minimum of 30 feet from the rear property line; and <br />WHEREAS, the proposal by Mr. Rebmann seeks to construct the bedroom addition 12 <br />feet from the rear (south) property line or an 18 foot encroachment. <br />WHEREAS,. the City Planner has concluded that "hardships" are present and support can <br />be given to deviate from the strict requirements of the Roseville City Code; <br />
