_ _ <br />D. CONTRACT ADMINISTRATYON. <br />1. The Ciry vc�ili prepare and execute a construction contract witl� the Iowest <br />responsible bidder, hereinafter referred to as the "Can�ractor," in accordance with <br />the specia� pravisions and t�ie �atest edition of MnIDOT's Standard Specifica�ions <br />for Construction and all amenc�ments ther�to. <br />2. The Project(sj will be constructed in accordance with plans, speciai provisions, <br />and standard specifications of each Praject. The standard specifications will be <br />the latest edition of Mn/DOT Standard Specifications for Higl�way Const�-uction, <br />and ali amendments thereto. The plans, special provisions, and siandard <br />specifications will be on �ile at the City Engineer's Office. The pIans, special <br />provisions, and speci�cations are incorporated into this agreement by reference <br />as though f�lly set fort� I�e�-ein_ <br />3. The City will furnish the personnel, services, suppiies, and equ�pment necessary <br />to progerly supervise, inspect, and document the work for the Project{s). The <br />services of the City to be perforrt�ed hereunder rnay not be assigned, sublet, az <br />trans%rred �niess the City is �atified in writing by Mn/DOT that such action is <br />permitYed under 23 CFR I_33 a�d 23 CFR 635.I05 and state law. This written <br />cor�sent wil� in no way �-eiieve the City frorn its primary responszbility for <br />perfarmance of the work. <br />4-_ The City wiil dacurnent quantities in accordance with the guidelines set forth in <br />the Mr�/DOT Contract Administration Manual Sections 410 and 420 that were in <br />effect at the time the wor�C was perforrned. � <br />S. The City wiit test materials in accordance w�th t�e l�i1r�.�DOT S�h�du�e �f <br />Materials Control in effect at the time each Project vvas let_ The City wili notify <br />Mn/DOT when work is in pro�ress on the Projec�(s) that requires observation by <br />t�e Independent Assurar�ce Inspectar as required by the Independent Assurance <br />Schedule. <br />b. The City �nay make changes in the pians or the character of the work, as m.ay be <br />necessary to compiete the Project(s), and may enter into supplemental <br />agreement(s) with the Contractor. Tt�e City w�ll not 6e reimbursed for any costs <br />of any work perforrned �nder a supplementai agreement uniess Mn/D4T has <br />notified the City that the subject work is eligible for federal funds and sufficient <br />£ederal f�nds are available. <br />7. The City wi�l request approval from Mn/DQT for all costs in excess of the <br />arnount of federal �unds previflusly approved for the Project(s) priar to incurring <br />such costs_ Failure to obtain suct� approval rr�ay resu�t in such costs being <br />disal�owed far reimbursemet�t. <br />8. The City wi�l prepare reports, keep records, and perforrz� work so as to enable <br />Mn/DOT to coitect the federal aid soug�t by t�e City.
