ARDEN HILLS CITY COUNCIL—January 10, 2011 6
7.A. Amend Sections 1305.04 and 1320 in the Zoning Code (continued)
City Planner Beekman stated this should not be underlined. This has always been in the Code.
Councilmember Holmes asked about Subd. 11.
City Planner Beekman stated Subd. 11, the definition for antenna is not new but rather has been
separated from the definition for dishes.
Councilmember Holmes stated the definition for tower is removed from Subd. 12. She asked if
this was defined somewhere else.
City Planner Beekman stated the definition for tower is in another subdivision so the duplicate
was removed from this section.
Councilmember Holmes asked why Subd. 57, Drive-in business, on page 8 had been removed.
City Planner Beekman stated drive-up window was incorporated into the code when the B2
design standards were established. Drive-up window is a more accurate depiction of what is
being regulated by those rules. The definition for drive-up business has not been used anywhere in
the City's code since the B2 design standards were established.
Councilmember Holden asked if businesses, such as grocery stores, that provided the service of
delivering items to a customer's car would now be considered in the drive up window definition.
City Planner Beekman stated the intent of the definition for Subd. 58 would be to define a drive-
up window. The definition includes any business that would bring goods to a customer's vehicle
as well. The City would need to decide if they want to regulate these types of businesses the same
as those with a drive-up window or if they would like to regulate them differently.
Councilmember Holden stated the Council should discuss this definition in more detail at a
fixture work session.
Councilmember Holden stated page 9, Subd 67 has been removed from the definitions. She
asked why the City would not allow an earth-sheltered home.
City Planner Beekman stated State Statute protects earth-sheltered homes and the City cannot
prohibit these. The definition is not necessary.
Councilmember Holmes stated she would like the Council to discuss Subd. 70 at a work session.
She asked if the City could change the requirement that no more than four (4) persons, some or all
of whom are not related by blood, marriage, or adoption, living together.
City Planner Beekman stated there is room to change this but she would request legal counsel
before this was altered.
