It is ur�[awfu! for any person fo t�-ans�aorf for disposal or to dispose af designatecf <br />recyclabfes in a mixed municipal soEid waste disposal facility. �he Contractor shall not <br />kandfill, incinerate, compost or rnake f�e] peElets out of the recyclable materials. <br />21. Designated primary giass market <br />The City anci Co�tractc�r hereby agree ihaf Anchor Glass Co�p. (Shakop��:, MN} shall be the <br />prirnary markef af choice for glass bottles and jars collected fro� the City's recycEing <br />progra�. The Cor�tractor shalf develop a pFoposed glass rnarketing eontingency plan in <br />w�itir�g for review, camment and approval by t�e Ci�y_ This coniingency plan shall be baseci <br />orr recycling g�ass info marfcets with the highes� anc� best use af tF�is cammodiiy. The <br />Contractor shal� provide ar� an�ua! assessment of the Anch4r glass marfcet as part of its <br />ar�nuai repart to the City. <br />The Confractor shall pro�ide as mucf� notice as possibfe iF #he Anchor g[ass plant cfoses, <br />stops accepting recyelable glass cullet, or otherwise becomes econ�mically unfeasible as the <br />primary glass market o�tlet. if Anchor is no longer a viabfe primary �arket �or gfass, and if <br />the Contractar m�st ad�ust its glass pracessing andlor rr�arketing op�rations, the Contractor <br />may submit a propflsed per ton fee amendrnent to the City. Tf�is per ton �ee amer�dment <br />proposaf rnust iRcEude a detailed cost justifeation for any �ee increase. Once the fee <br />ar�endment prvposai is submitted, #he City shaEl have 3� days fo negotiate a fina� fee <br />amendment with #he Contractor fo� approva! by the City CounciE. <br />22. Processing facilities must be specified <br />The Con�ractor shal# assure the City that adec�uate recyclaL�le material processing capacity <br />wilf be provided for City materiaf colkected. The Contractor sl�alf pro�ide written notice to tf�e <br />City at feast 6Q days in advance o# any substantia! change ir� these ar subsequent plans fo� <br />receiving and pracessing recyclables coilectec� from the C�ty. <br />23. Estimating materials compos�tion as collected <br />Tl�e Co�iractar shail cancE�ct a# least one mater�afs composition a�►alysis of the City's <br />recyclab�es each year to estimate the relative arr�ount by weigk�t af each recyc�ab�e <br />cammodity by grade. The results of this ana[ysis shali include: {1) percent by weight of eaeh <br />recyclab{e comrr�odity by gracle as coltected from the City; (2} retative c#�ange compared to <br />ihe previaus year's comp�sition, anci (3) a deser�ption of the methodology used to calculate <br />1� <br />
