] 1. The par3cir�g lot and road are 75 feet fram the eastem property line, which is in <br />conformance with the approved PUD Master Plan. <br />12. The lighting design meets the requirements of the City Zoning Code and the PUD Master <br />P3an. <br />13. The landscaping plar�s inelude the removal of 1� 6 trees with a total of 1,463 caliper <br />inches. The landscaping plans include 229 replacement trees with b27 caliper inches. <br />The proposed plans nr�eet the landscaping reqUirenrzents xn the City Zoning Code and �he <br />PUD Master Plan. <br />Recommendation <br />T�e Planz�ing Commission reviewed Planning Case 08-006 and recom�ends approval (6-0) of <br />the Site Plan Review based on the findings of fact and the submitted plans as axr�ended by the <br />following twenty-one conditions: <br />�. The applicant shall continue to abide by the canditions of all previous permits and <br />rev�ews. <br />2. 7'he praject shall be completed in accordance with the p�ans submitted as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City P�anner, shall require review ar�d approval by the Planning Commission and <br />City Councii. <br />3. A S�te Plan Agreement, drafted by the City Attorr�ey, shall be subject to City Council <br />approval and signed by the property owner prior to any work being done on the site. <br />4. The applicant shall submit a financial surety in a form acceptable to the City Attorney <br />for 125 percent of tl�e cost of materials and �nstalla€ion of the landscaping plan priar <br />to the City issuing any permits. The City shall retain the financial surety for at least <br />ane year after full irnplementation af the Iandscaping plan. The frnancial surety shall <br />only be released �apon successful inspection of the landscaping hy the City Planner, <br />which shall only occur during the growing season. <br />5. A temporary fence shall be placed betvreen the const�-uction area and the trees that are <br />to be retained on drawing L203 in Attachment D. The fence shaIl be subject to C�ty <br />Planner inspection and shall be in place priar to the issuance of any building permits. <br />The fence shall be �naintained and shall not be removed without City Planner <br />approval. <br />b. If any of the retazned trees ora drawing �,203 in Attachment D are removed or <br />damaged by any natural or manmade force prior to Staffls final inspection of ihe fully <br />implemented landscaping plan, Northwestern College shall replace 125 percent of the <br />removed caliper inches af trees. The replacement vegetation shall be subject to City <br />Planner and City �orester :review and approval. <br />7.
