ARDEN HILLS CITY COUNCIL — August 8, 2011 5 <br />6. PUBLIC HEARINGS <br />None. <br />7. NEW BUSINESS <br />A. Cruisin' for St. Jude Fundraising Event — Flaherty's Arden Bowl <br />Deputy Clerk Rebecca Brazys stated Tom Flaherty contacted the City in February regarding a <br />fundraising event to be held in the parking lot of Flaherty's Arden Bowl. This event would <br />include a motorcycle ride, music, 3.2 beer sales, and charitable gambling. The City Attorney was <br />contacted and he responded to the City with several concerns. The Deputy Clerk then forwarded a <br />copy of the City Attorney correspondence to Mr. Flaherty on March 3 outlining the City's <br />concerns with the event. The planning for this event proceeded and the City was not made aware <br />of this until mid -July when Mr. Flaherty attempted to obtain a Temporary 3.2 Beer On -Sale Only <br />License for the event. Because the event includes live music, the City Attorney recommended Mr. <br />Flaherty apply for an Outdoor Concert License. City Code requires Council approval for the <br />issuance of this license. Even though Flaherty's liquor license applies to the building, Al Erickson <br />of the Minnesota Department of Public Safety — Alcohol and Gambling Enforcement, has <br />indicated that the Temporary 3.2 Beer On -Sale Only License is a City license and it is the City's <br />discretion whether or not to approve it. Mr. Flaherty has submitted an application and a written <br />request for Council permission to allow outdoor 3.2 beer sales. Terry Dehkes, event coordinator, <br />contacted the Minnesota Gambling Control Board regarding the drawing, raffle, and silent auction <br />planned for this event. The Gambling Control Board advised him that the drawing and raffle <br />could not proceed because Mr. Dehkes does not have non - profit status. Commercial Building <br />Inspector Dave Scherbel has approved the proposed layout for this event. No permits are required <br />for the tents to be used and the stage height is less than 30" so it is considered a platform and does <br />not require a permit. Since the seating will be folding chairs with no bleachers there is no permit <br />required for seating. City Planner Meagan Beekman has reviewed the Outdoor Concert License <br />application and raised no issues that require City Council action. <br />Councilmember Holden asked how the event was expected to work once people registered. <br />Mr. Terry Dehkes, event organizer, stated all the riders would need to register at Flaherty's. <br />Once registered, they would proceed to Stillwater, Taylor's Falls, North Branch, Forest Lake, and <br />return to Flaherty's around 5:00 for food and music. They will be stopping at a bar in each <br />location and staying for a short time before proceeding to the next location. The entire route is <br />about 120 miles. Once they are done and return to Flaherty's they are expected to remain for a <br />longer period of time to enjoy the music and food and the silent auction. <br />Mayor Grant asked what the layout of the parking lot would be for the event. <br />Mr. Tom Flaherty, representing Flaherty's Arden Bowl, outlined the parking lot layout including <br />where the bikes would be parked, the stage would be set up, and the vending area would be. <br />Councilmember Holden clarified there was an expected 250 participants in the event but only <br />chairs for 100 people. <br />
