ARDEN HILLS CITY COUNCIL—OCTOBER 8, 2012 4 <br /> MOTION: Councilmember Holden moved and Councilmember Tamble seconded a <br /> motion to adopt the updated version of the City Commissions, Committees, <br /> and Task Forces: Recruitment, Appointment, and Term Limit Policy as <br /> amended. The motion carried unanimously (5-0). <br /> B. Memorandum of Understanding with AT&T for its 4G LTE Upgrade at the <br /> Cummings Park Water Tower <br /> Councilmember Holmes questioned if there is anything written into the wireless provider <br /> contracts with regard to the painting of the water towers. <br /> Community Development Director Hutmacher stated that current contracts with wireless <br /> providers who lease space on the City's water towers do not address that point. She noted that the <br /> contract with AT&T expires in 2014. In the Memorandum of Understanding (MOU) for AT&T's <br /> 4G LTE upgrade project, the City and AT&T agree to negotiate a new lease. The City will ask <br /> that the new lease address the fact that the tenant will need to remove/reinstall its equipment when <br /> water towers are repainted. The AT&T agreement is 30 years old. As lease agreements expire, <br /> it is becoming standard to include that type of language. The City is working from a League of <br /> Minnesota Cities standard contract and the League is encouraging cities to include this type of <br /> information in their water tower leases. <br /> Assistant City Engineer Anderson noted that the Council passed the Sanitary Sewer <br /> Maintenance Policy this evening. He stated that a water policy is also being created, and as part <br /> of that process, an assessment of the water tower conditions has been done. Water tower <br /> maintenance does need to be addressed in the future. The Engineering and Community <br /> Development Departments are working together to make sure that future legal agreements <br /> facilitate the maintenance activities that need to be completed. <br /> MOTION: Councilmember Holden moved and Mayor Grant seconded a motion to <br /> approve the Memorandum of Understanding with AT&T for the 4G LTE <br /> Upgrade Proiect at the Cummings Park Water Tower. The motion carried <br /> unanimously (5-0). <br /> 7. PUBLIC HEARINGS <br /> None. <br /> 8. NEW BUSINESS <br /> None. <br /> 9. UNFINISHED BUSINESS <br /> None. <br />
