City to evaluate the SSO collection program in six or twelve months. The City Attorney advised <br />staff that a Conditional Use Permit runs indefinitely and may not be terminated except for <br />violation of its terms or with the consent of the property owner. In this case, the City could elect <br />to issue an Interim Use Permit for the SSO collection area instead, which can be granted for a <br />term of up to three years. Staff has reviewed this option with the applicant and they would be <br />supportive of this approach. <br /> <br />It should be noted that the Conditional Use Permit application in Planning Case 14-008 is for <br />both the new SSO collection area as well as the existing yard waste operation. While the yard <br />waste site has been operational since 1984, staff has not found a formal agreement or permit <br />between the City and County regarding activities on the site. Staff believed that with Ramsey <br />for an SSO collection area, this was a good opportunity to formalize the <br />existing use of the property under a single Conditional Use Permit. <br /> <br />If the City Council wishes to approve an Interim Use Permit for the SSO collection area, it could <br />also make a separate motion to approve a Conditional Use Permit for the remaining activities on <br />the site. With an approval of both an Interim Use Permit and Conditional Use Permit for the <br />separate activities, the conditions of approval for the two permits would need to reflect the <br />different uses and their expected impacts. <br /> <br />A vote to deny Planning Case 14-008 would not affect the existing yard waste operation, as it <br />would continue to be considered a permitted non-conforming use. <br /> <br /> <br />Hours of Operation <br />The Planning Commission requested additional information from the applicant on the hours of <br />operation for the site. Currently, the yard waste site is only open from April through November <br />on Monday, Wednesday, Friday, Saturday, and Sunday. With the addition of the SSO collection <br />service, Ramsey County would keep the site open on all weekends throughout the winter. <br /> <br /> <br />Traffic <br />Ramsey County expects the SSO collection component to be relatively minor in relation to the <br />overall activities on the site. Currently the site averages approximately 50,000 visits per year. For <br />initial estimating purposes, the County has assumed that by the end of 2014, approximately 200 <br />households will be using the SSO collection service on a somewhat regular basis. Many of those <br />participating are likely to be residents who are already using the site to drop off yard waste.
