Findings of Fact <br /> <br /> <br />The Planning Commission reviewed Planning Case 14-008 at their meeting on February 5, 2014 <br />and offers the following twelve (12) findings for your consideration: <br /> <br /> <br />1.The property at 1761 Lake Johanna Boulevard is located in the R-2 Single and Two Family <br />Residential District. <br /> <br />2.The Source Separated Organics collection service proposed by the St. Paul-Ramsey County <br />Public Health Department is considered to be a public use. <br /> <br />3.A Conditional Use Permit is required for a public use in the R-2 District. <br /> <br />4.Section 1355.04 Subd. 3 of the Arden Hills Zoning Code lists criteria for evaluating a <br />Conditional Use Permit request. <br /> <br />5.The proposal will have limited impact on existing and anticipated traffic and parking <br />conditions. <br /> <br />6.The proposal will have limited impacts on odors and solid waste. <br /> <br />7.The proposal will not affect noise, glare, vibration, smoke, dust, air pollution, heat, and liquid <br />on the property. <br /> <br />8.The proposal will not affect drainage on the property. <br /> <br />9.The proposal will not affect the population density on the property. <br /> <br />10.The proposal is unlikely to significantly affect land values on the subject property or on <br />neighboring properties. <br /> <br />11.The park dedication requirement does not apply in this case. <br /> <br />12.Where the proposed use is expected to impact the health, safety, convenience and general <br />welfare of the owners and occupants of the surrounding land, conditions may be placed on a <br />Conditional Use Permit to mitigate such impacts. <br /> <br /> <br />Public Comments <br /> <br />A public hearing regarding this case was held at the Planning Commission meeting on February <br />5, 2014. Two local property owners were in attendance at the meeting and provided comments. <br />One resident requested additional information on the operations of the program and the second <br />expressed concerns about odors, the attraction of unwanted wildlife, traffic, and dumping of <br />organic materials. A complete record of their comments are included the draft Planning <br />Commission minutes from that meeting (Attachment I). <br /> <br />Staff has received several emails and letters and one phone call from residents in the area <br />expressing opposition to the proposal. These emails and letters have been included in Attachment <br />G.
