Findings of Fact

The Planning Commission reviewed Planning Case 14-008 at their meeting on February 5, 2014
and offers the following twelve (12) findings for your consideration:

1.The property at 1761 Lake Johanna Boulevard is located in the R-2 Single and Two Family
Residential District.

2.The Source Separated Organics collection service proposed by the St. Paul-Ramsey County
Public Health Department is considered to be a public use.

3.A Conditional Use Permit is required for a public use in the R-2 District.

4.Section 1355.04 Subd. 3 of the Arden Hills Zoning Code lists criteria for evaluating a
Conditional Use Permit request.

5.The proposal will have limited impact on existing and anticipated traffic and parking
conditions.

6.The proposal will have limited impacts on odors and solid waste.

7.The proposal will not affect noise, glare, vibration, smoke, dust, air pollution, heat, and liquid
on the property.

8.The proposal will not affect drainage on the property.

9.The proposal will not affect the population density on the property.

10.The proposal is unlikely to significantly affect land values on the subject property or on
neighboring properties.

11.The park dedication requirement does not apply in this case.

12.Where the proposed use is expected to impact the health, safety, convenience and general
welfare of the owners and occupants of the surrounding land, conditions may be placed on a
Conditional Use Permit to mitigate such impacts.

Public Comments

A public hearing regarding this case was held at the Planning Commission meeting on February
5, 2014. Two local property owners were in attendance at the meeting and provided comments.
One resident requested additional information on the operations of the program and the second
expressed concerns about odors, the attraction of unwanted wildlife, traffic, and dumping of
organic materials. A complete record of their comments are included the draft Planning
Commission minutes from that meeting (Attachment I).

Staff has received several emails and letters and one phone call from residents in the area
expressing opposition to the proposal. These emails and letters have been included in Attachment
G. Generally, the concerns raised focus on the impact of odors on neighboring residential
properties, attraction of unwanted wildlife, dumping of organic materials, cleanliness of the site,
environmental impacts, incompatibility of the use with other park facilities and activities, and the
increase of traffic congestion on Hudson Avenue, which provides access to the collection site.

______________________________________________________________________________
City of Arden Hills
City Council Meeting for February 24, 2014
P:\Planning\Planning Cases\2014\PC 14-008 - Ramsey County - CUP Yard Waste & Organics Site\Memos_14-008

57
Page of
